Green Supplier Ltd. credit balance still not refunded - take them to court / am I owed compensation?

Hi guys,

In a nutshell I left Green in September for EDF just before Green went bust. The transfer to EDF went through but as the appointed SoLR, Shell now owe me £135.17.

Green issued my final bill 26th November. Referring to the following guidance from Ofgem, I have two questions:

1. Should I take them to court to get the money back?
2. Am I entitled to 2 x £30 payments as more than 20 working days have elapsed since my final bill was issued?

"Customers will also be entitled to a £30 payment if their previous supplier is late in refunding them their credit balance after they have switched.

Under Ofgem’s rules, suppliers must refund these credit balances within 10 working days of a final bill being issued.

Suppliers are required to pay compensation automatically to the affected customer within 10 days of the breach occurring. If they fail to make the initial payment, they will be required to make a further payment of £30."

    Think you will find that you are not entitled to compensation for non payment of final balance when moving to SOLR.

    You won’t get switching compensation if you are a business energy customer or if your supplier has gone bust.  Taken from OFGEM Site.

    Contact Shell via Twitter or Facebook Messenger and request payment of Credit Balance from Green. I asked December 14th via messenger and got my cheque 29th December. Supplied screenshot of my final bill from Green showing credit balance.

    1) No point taking a defunct supplier to court you won't get anywhere.
    2) A supplier without a supply licence is not governed by the OFGEM regulations so you are not entitled to compensation.
    The SoLR will get round to you eventually.  In some previous failures it took over a year to refund those who left before the supplier failed.  Unfortunately you are at the bottom of the pile to get sorted but they will get to you eventually.  You are still protected by the SoLR process.
