CE Popla Appel rejected

Apologies for a new thread but I'd massively appreciate some help here. My appeal to Popla was rejected surprisingly for two PCN's by Civil Enforcement (CE)
I thought i'd win given the grounds but they've sided with CE. I received two tickets so far so parking without a permit as I visited a gym. The gym allows 2hrs free parking when keying in your number plate. I did this on both occasions but it did not register on CE's system. I obtained attendance logs from the Gym and thought that would be it but they instead claimed I either didn't do this or keyed in the wrong reg. In CE's defense to Popla they supplied a log of all visitors that keyed in thier reg that day and i simply said if it didn't register it wouldn't be on the the CE log. As the gym leases the space they are unwilling to speak to CE to cancel the ticket and now the reduced rate opportunity has disappeared as I appealed to Popla so any advice would be greatly appreciated. Do I take the hit and pay £200 or do i have grounds to fight this?

    Everyone has grounds to defend these PCNs , especially ones like your case , in court , within 6 years

  • Not had the pleasure of dealing with CE before, do they usually drag this out to court or are they the type to send bailiff letters to scare you into paying?

    Both: silly letters and meritless court claims that we win.

    This is absolutely not to be paid.  CEL are easy to beat in court.  No risk and quite fun (well, a useful life experience) believe me!

     In CE's defense to Popla they supplied a log of all visitors that keyed in thier reg that day.
    Keep if safe.  Is anything similar to your VRMon It?  Partial plate?

    At court evidence stage, later this year, ask them for it again without reminding them that they already provided it at POPLA stage.  Then compare the two versions.

  • Yes I still have it, attachment wouldn't open on the Popla portal so they sent PDFs, unfortunately none of the vreg match even partially. Thanks guys you've given me some confidence to fight this. 

    Guess I'll await thier next steps. What's annoying is after the first appeal to CE they offered me a reduced rate of £20 as it was a 'keying error' obviously I rejected that and since went via Popla its now £100 per fine.

    At least you have evidence that they agree this is a keying error   That will help in a defence later.

  • Looks like this is far from over, today I recieved further threatening letters asking me to pay or bailiffs will be sent and my employer would be notified (new one for me) and they could take the payment via my salary. More than likely its nonsense but any truth to this?

    More worried about the bailiffs as I plan to fight this in court. Any chance of then sending anyone round before court action?

    You can name the idiot firm that said that.  ?  Only a court can decide that, not a jumped up money scammer .... WHO IS THIS FOOL ?

    IAN\Ll but IIMU that this is against the law. and should be reported to the  police. 
    You never know how far you can go until you go too far.
  • Its been a while but I'm in an awkward position with this case. Its now heading towards court with a date set. Issue is I'm not in the country during the court date. Reached out to the courts who have said my only options is to pay £110 to adjourn it or get an agreement from CE which is just such a stupid process. 
    Firstly how can the court come up with an arbitrary date and expect you to show up, secondly the CE would never agree to defer as it serves no benefit to them. I really dont want to pay £110 for the adjournment on top of the fine should I lose. 
    Any advice would be appreciated. If I didn't attend would my fine increase or stay the same, also should neither me or CE attended the court date what happens in this instance. 

    Tempted to pay it all off but really dont want to lose to these scumbags.
