    just checking.......do you need to mention on the mcol website that you have sent the defence via email?

    For the hard of reading, here it is again...
    Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    just checking.......do you need to mention on the mcol website that you have sent the defence via email?
    No , you need to check for an email auto receipt back from the CCBC , to show that they received it

    Then check your MCOL claim history later this week , to check that they logged it and also sent it to the claimant

    You treat MCOL as read only , no ticking boxes or tags , no filling in sections , just read only , capiche ?

    Once your defence is logged by the CCBC , check the claim history weekly , to see when they have posted out an N180 to you ( DQ ) , so again , read only

    Follow the 12 numbered steps by coupon mad in the defence template post , no going off on your own , no doing anything we haven't told you to do

    Go back to that list you were following when you filed your Defence.
    You appear to have stopped at iem5.

    Item 6 on that list is...

    Items 7, 8, 9 and 10 are now worthy of your attention.

    i thought it was the questionnaire which i now know has to be emailed and copied to premier park, and then it will be witness statement and accompanying photos?

    Yes, as the NEWBIES thread covers.  DQ and WS stages are fully explained and there is a red heading 'IMPORTANT - Know what happens when' with links to how to do each stage. 

    As a heads up so you can read ahead:

    The WS by @jrhys and @Nosy are the best 2021 examples of how the bundle and exhibits should all look, with page numbering and evidence, plus a costs assessment.

    But of course there is now more to add to the 2021 efforts!

  • hi we have a dispute resolution hearing with a Dudley County Court judge next month.  Im compiling a witness statement as laid out in the templates. I was just wondering if you need to incorporate your defence in this or have it as a separate document , or to not bother at all because you have already filed the defence?

    Your choice ... it doesn't hurt (and can be helpful, as everything is in one place) to include it as an appendix, but if the WS+evidence compiled file gets too big then drop the defence appendix as that document is already with the court and claimant. :)

    Don't include the defence.

    Don't use the Robert Cox example or the Southampton Crosby case that's still in the NEWBIES thread as that's out of date now.

    See recent example WS by @aphex007 and @wobsk for how to word a WS and what evidence to include.

    You know a half hour DR hearing isn't your final hearing?  Just a pseudo-mediation waste of time paper-shuffling exercise, with a rookie Judge who will pressure you to think you have no case, and to settle?

    NO THANKYOU SIR (OR MADAM) is the answer.
