Reclaiming Inheritance Tax already paid

My father in law has recently died and we are in the process of applying for Probate. We have found out about transferring his wife’s nil rate band for Inheritance tax purposes which is great . My father died in 2020 and we were unaware of this. Is there any way we can reclaim this tax as it was in the region of £55k.

    Probably best if you call the Probate office and explain the details. You will have the necessary application numbers to quote and I believe you will find them very helpful.

    I'm a retired IFA who specialised for many years in Inheritance Tax, Wills and Trusts. I cannot offer advice now, but my comments here and on Legal Beagles as Sam101 are just meant to be helpful. Do ask questions from the Members who are here to help.
  • You will need to send a IHT402 within 24 months of the date of death.

    The probate office do not deal with IHT issues, the OP needs to call HMRC for advice. (0300 123 1072).

    IHT402 is the form that it should be claimed on when submitted with IHT400. Not sure if you will also have to submit an amended IHT400 as well.
