I have another question regarding mental capacity.

I'm on ESA and PIP.
I have savings over 4k in my personal accounts and another 7k in my appointee account (which 6k will be used paying a holiday off to Israel with me and my staff this Feb including staff hours) If the holiday doesn't go ahead and the 6k is returned to me. This leaves me with 11k in my personal saving account. I'm continuing to save £900 a month from my benefits. I'm have holiday booked to Israel in June so thats saving another 5.4k if I don't go. Total saved 16k. I them spend the 7k on a Omega watch would this be depriving myself of assets. If I lack capacity would I get into trouble as apparently according to the intellectual disability service at Social services I lack mental capacity with finances.

All of your savings, regardless of where they are, are counted. If you have an appointee for benefit purposes then it's their sole responsibility to report all changes and this was one of the things they signed for when they became your appointee.If your savings reach more than £16,000 and you spend £7,000 on a watch then yes it could be seen as deprivation of capital.The only person that can decide what deprivation of capital is will be a DWP decision maker because there's no definition of deprivation of capital.1

I would have to go into travel agent and put my card in their machine and they refund money that way. The money comes from multiple places like my credit card for despoit then appointee for rest of cost. They did it like this last time I got a refund.0
