Yes you do, as the Template Defence tells you. Concisely summarise the facts that the WS will later expand on.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Okay, thank you. I have worded the below, how does this sound?
"Upon said research, the Defendant also finds that the car park is medium in size with buildings and local businesses standing on 3 sides of the car park. With the car park at 3 quarters capacity, it was difficult to read the layout of the car park and any signage pointing to the pay terminals."
Many thanks,
D0 -
I could add
"After searching for the pay terminals, one was located not in plain site, making it very difficult to find."
Thanks,
D0 -
I suggest that you post your proposed numbered paragraphs 2 and 3 below , for critique , keep doing so until they are the best they can be , these musings don't help unless you post your amendments1

Thanks,
DNote that spelling and grammar are important so "plane site" becomes "plain sight".You are half way there.

Hi, I have since had back the Subject Access Request from the parking company. I am worried because their pictures show my car, in the car park, with parking signs in the background (the signs are not legible from the photos, but clearly parking signage).
What leg do I have to stand on? Any thoughts on what my defence could be please?
Many thanks,
D0 -
They have said in their email regarding the SAR that "PDT data is not stored". Would this be my angle?
Thanks,
D0 -
You stand by your defence and you submit your own photos at witness statement stage showing the difficulty/impossibility of seeing signs, reading signs or finding a PDT.2

@Le_Kirk but the pictures clearly show parking signage. I think one picture even shows a PDT in the background. I feel like I don't have a leg to stand on now. Surely the judge is going to laugh me away if my defence is that I couldn't see signage or PDT machines?
Thanks,
D0 -
Doesn't mean you saw them! Was it dark/dusk/sunrise/sunset? Were the signs obscured by trees/other vehicles? Was the car park and the signage and PDT illuminated (if it was dark)?1
