No response for wrong size shoe

I bought some snowboard boots from a UK website using a Visa Credit card.

The boots arrived but they were not the size I ordered. I contacted the customer services and they asked to provide photographic evidence of the problem which I did. I waited a few days but got no response and then contacted them several times after to get the problem resolved. Each time I got no reply. 

I then contacted the credit card company to resolve the problem and supplied them with the evidence of my efforts to contact the seller. The credit card company issued a credit for the full amount back to my credit card.

Now as if by magic the seller has suddenly contacted me to return the goods after previously having ignored/stayed silent.

Where do I now stand with having to return the goods or not?

    Of course you have to return them; why would you not? 
    If you don’t, the company can dispute the charge back. Just ask them how to arrange the return so they pay for it.

    Pedant alert - it's could have, not could of.
  • Where do you stand?  In socks. Of course you have to return the boots.  You've been refunded, the boots don't belong to you any more.

    Why would you think you can have a refund and keep the boots?

    have they supplied a return label etc so there is no cost to you to return

    They have supplied a return form but not a prepaid label of any sort. They seem to expect me to cover the cost  and then they will refund me that cost once they receive it. 
  • Sounds like they're a little suspicious you won't return the boots you haven't paid for.

    This is your chance to prove them wrong.

    Make life easy for yourself. Just return the boots and then get the postage refunded.

    No, don't do that. If you pay for the postage then the risk in transit lies with you, and if they are 'lost' you are responsible.

    Get them to supply a pre-paid returns label - that way the contract is between them and the carrier (eg RM) and the risk lies with them.
  • I wouldn’t be paying for the return - they can send you a label. 
    But you do need to return them, yes.

    I checked the cost of postage to return the item is actaully nearly double what they have offered, so sent them a reply to see how they respond to this.

    You can keep them and re-pay for them, or you can send them back.

    They need to pay for return postage though, so just ask them to email you a pre-paid courier or RM return and you will happily send them back. It will cost them much less as they will have a business contract with a courier or similar. 

    (You don't want them to send you the money to return them, you would like them to send a pre-paid returns thingy, as that way THEY are responsible for the return, not you.)
