If there are no arrears, how come you "got notice from lender that they will take legal action and house be repossessed". They would not do that without good reason, especially given the court decision.However they are unlikely to grant you a mortgage in your sole name, without which the transfer from ex to you cannot go ahead (due to the existing Mortgage Charge on the property).To get a mortage you'll have to* get together some capital as a bigger deposit so as to reduce the size of loan you need* increase you earnings to make the mortgage affordable, or* apply forajoint mortgage with someone else with a salary to add to yoursBut I suggest you speak to an independant mortgage broker

I was told once the bank transfer is made via solicitor into his account he then sign’s documents from the bank releasing himself from the mortgage and it get transferred into my name and I need to show that I can continue paying the mortgage..

When I divorced during the court stage my ex wife provided proof (aip) she was able to buy me out of the house for my percentage of the house plus the outstanding mortgage this was with a different lender to our previous joint mortgage.The judge set a deadline, I think this was 12 weeks for her to do this and me to receive my money.Everything was set out in the financial settlement, who was having what and the deadline for payment etc.3
