Repossession mortgage joint.

    I dont think the financial ombudsman can/will do anything. 

    For a start he has 13 days, it will take the financial ombudsman longer than that to look at it. Although they may ask the bank puts a hold on anything. Thats assuming they can do something. I dont think the ombudsman can go against the courts, but they may be able to get it put on hold whilst it goes back through court. 

    You normally have to make a complain within 6 years, which is sounds like it is now outside of, although exceptional circumstances might be applied with your friends partner committing suicide. 

    This all sounds very messy and your friend appears to have put their head in the sand for 6 years. Personally, I think if someone has struggled to get to grips with everything in 6 years, they are probably not going to do what needs to be done in 5 working days.

    Even now saying they want to enjoy Christmas does not sound like the type of person who wants to try and fight for their home. If I received a letter telling me to be out of my home on Christmas even to say I have 15 days to leave, you can be pretty sure it would be me on here, not a friend. I would be calling up solicitors - does he have legal advice on his home insurance policy? 

    I am all for helping friends, but this sounds like it will be you doing everything. 

    I think the easiest thing to do will be to speak to the bank, agree to sell the property as you will get more for it and then take whatever profit there is and start afresh. Although I suppose his credit report may also come into play here.

    And my friend has been meaning to phone the mortgage advisor for months now and still hasn’t managed it. 

    I know he feels that the house has been a bad omen since the start. So maybe this is an excuse of “it’s been taken out my hands” or an excuse for a new start in completely the wrong way,  so to speak.

    I’ll will still try and get him to call the bank as he’s got to try something like you say even if it’s an “agree to sell”.
