Repossession mortgage joint.

My friends in a sticky situation.
2015 a court hearing took place for a repossession order on the house which he still jointly owned with his ex.

his Ex has pushed for this repossession order as a way of getting off the mortgage. 

From what I can gather- the original hearing (2015) took place whilst my friend was working away on business and came home
to notification that it had been granted.

But then heard nothing more. 

The my friend lost his current
partner to suicide in 2020 and his dog October 2021 (the only living link to his partner)- So mentally he’s been in a very very bad place and had no motivation to deal with anything. 
Last night he went home- to find a letter saying he needed to be out by the 11/1/22
I am gathering its an eviction notice. 

But he doesn’t want to deal with it (and probably can’t) until after Christmas now as I his terms.. “He wants to enjoy his last Christmas” 

He’s staying with myself currently as I want to support him as much as possible. 

But any advice for when he’s able to deal
with would be gratefully received.

    Shelter can be a helpful resource in circumstances like this.
    It is also very unlikely that this is the first contact there has been since 2015, so if he is able to begin talking about this after Christmas, gathering any other letters that may have been sent to him would be a good idea as well (if they still exist of course).

    Thank you, it’s U.K. property not sure what the letter says exactly as he doesn’t and can’t due to bank holidays address at the moment he just wants to enjoy Christmas. 

    But I’m sure I’ll find out soon.

    Indeed, it's a completely different process in each jurisdiction.

    as above this is unlikely the first letter and in the last 6 years. They will have limited options as the lender has had to go through courts for a repo. It will be expensive and any equity will be eaten away and you will still owe the bank money if there is still money outstanding after sale.

    Thank you they are in the U.K.. 

    I don’t believe this is first contact they’ve had since 2015 but due to his partner committing suicide he’s been in a depression for nearly 2 years of that.

    Mortgage started 2020, aiming to clear 31/12/2029.

  • I will add he tried to get support from the bank back in 2015 and they didn’t offer any support or advice- as he’s got evidence to prove that he has been single handedly managing the mortgage as per the original agreement but in his words “they didn’t seem interested or offer any words of help or advice” 

    I suggested he probably needs to raise this with the financial ombudsman.
