Blonderabbit here. I have an ongoing dispute with yours truly PDG. Over a parking issue in Hull. Today I have received the response re the Sar I sent them - simply stating - a sar cannot contain personal info on a company as it’s not a living person. Same response I had from PDG. Also today I have received a response from the court saying when arranged the hearing will be held in Merseyside 🤷‍♂️. I live in Hull, PDG lives near Hull. This is obviously yet another underhanded tactic to get me to just pay instead of travelling 300 miles back and forth. Any advice is appreciated as today I’m feeling V angry.

    @Blonderabbit, why have you started a second thread about this incident?

    Any hearing is likely to be by telephone. 
    Is the Defendant an individual or a company? You've probably already answered that in your earlier thread.

    Please get your threads merged.
  • Hi my original thread was removed, for various reasons. So this is why I have abbreviated. The defendant is me though my van is registered to my business (a soletrader.)  the action is against my business 🤷‍♂️

    So the Registered Keeper is your business, yet the Defendant is you as a named individual. Is that right?

    With a 'company' Defendant, the Claimant gets to choose the court, but as I said, any hearing is likely to be by telephone so the actual location of the Judge (possibly also working from home) is not particularly relevant.
  • The registered keeper is my business. I have looked up Dcb online and they have an impressive list of reviews, and online presence - it’s worrying, I can see me losing even though this is outrageously wrong, I simply delivered an item to a work colleague who requested the item - I didn’t leave the vehicle - it’s totally unfair - I’m at a loss.

    Not from defendants they don't!   No idea why you think the company will lose.  If the driver wasn't carrying out work related business then the company D is not liable unless the PPC fully complied with the POFA, which I doubt PDG did.

  • I haven't seen your defence but with it being a delivery to a residence you no doubt have the legal precedence cases mentioned on here. I would use a question to DCBL to ask how it would it be possible for a milkman to deliver a pint of milk or a postman to deliver a parcel? What does it say in the landowner contract about that? How could anyone ever have anything delivered? Are there any signs saying no deliveries? Then I would ask them to define parking against stopping and delivering.
