Then when the usher called us both, the solicitor was for VCS but not for my case!

The judge didn't seem too pleased about the particulars of the case and asked VCS to go through them. Starting with the 3 residential invoices. VCS said that they were wanting me to pay because I hadn't bought a ticket/displayed a permit. The judge went through the writing on the sign which did state 'If a permit is required it must be displayed'. The judge asked what made a permit a requirement. VCS stated that when I signed my tenancy, I would have received permits which I should have displayed. 

The judge asked me if I received any permits when I signed my tenancy - I replied no. The judge also asked how access to the car park was gained. VCS said they didn't know and I said that a key fob was a requirement. I told the judge that I received a key fob upon signing my tenancy agreement.

The judge then said that because I had a key fob and a tenancy agreement but not given any permits - I had a legal right to park there and it was impossible for me to comply with the signs. Therefore the 3 residential tickets were dismissed on that basis.

Then we rolled on to the Berkeley Precinct. (I was trying to hide my smile here)

The judge straight away queried the Excel company number and VCS company number. After some companies house searching, the judge ruled that the two companies were separate legal entities and VCS couldn't try and sue me based on that. Claim struck out

So, 3 dismissed and 1 struck out!

Yes, the judge asked me what I wanted. I was a bit flabbergasted at this point - just asked for the standard witness costs (I don't even know what that means)

The judge asked me if I paid for parking, if I took a day off work. I said yes to both and I need to provide a parking receipt and wage slip via email to get those costs paid.

You will get £95 for a full day off work, plus parking costs.  Or a half day if he wants to be stingy. Nice!

Promise us please, that like us, you will do the upcoming DLUHC Public Consultation this year, and that you have read, understood and bookmarked the latest posts on the Announcement thread by MSE_JC?

We will post when the Govt releases their impact assessment and opens the Consultation. Probably into early 2023 now, I guess.

VITAL that people respond to the Government about the level of parking charges and the banning of the false DRA 'fee' that feeds the toxic roboclaim firms and 'race to court' mentality.

Yep I've already bookmarked the thread. Will also say if anybody reads this thread back (as I did with many others) and you need some help or advice I'd be happy to help where I can

Well done, a very smart judge

It's obvious that if someone is given a key fob, they have permission to park.
No doubt the permit  rubbish was the dreamwork of VCS
A real legal would have seen this ?   But sadly, this is a mickey mouse industry

It is also obvious about two entities and that is sheer incompetence on behalf of VCS and the legal.  Britannia parking did the same with their numerous company set ups and they were also spanked in court

Let's face it, these rubbish claims should be allocated to the local play school

OMG now I feel bad for assuming!

People do that to me on this forum all the time because I'm not a he either, so I'm the last person who should presume your Judge was male!
