Employer not given a ssp1 form

So just over two weeks ago I handed in a sick note to my employer that starts on the 31st November to the 31st of December. Hadn't heard anything from them so it thought everything was fine, today I wasn't paid anything and messaged a manager and she said I wasn't eligible which is true but I'm just a little annoyed they didn't say anything and probably wasn't going to if I hadn't messaged. Looking online it says they should have sent me an SSP1 form within the first seven days? I'm a full time student so I can't receive universal credit and am now stuck without money over Christmas, what should I do?

As they do not seem to knowledgeable about what they need to do might be worth checking if they are correct on you not being eligible. What was there reason for not paying?0

They haven't gotten back to me officially, but the manager I'm messaging says I haven't worked enough. If you have no entitlement to SSP, and you say you have no entitlement to UC either, what difference do you think having an SSP1 is going to make? Irrespective of that, the employer is legally obliged to provide the SSP1 to show why there is no entitlement to SSP.

Looking online, I think I might be eligible for Employment and Support Allowance and I need an ssp1 to support my application. The actual calculation for SSP is a bit complicated and involves working out an average over an eight week period (or less if recently started) For example for a weekly paid employee it is the last payday before the first full day of sickness plus the seven paydays before that divided by eight. If that is at least £120 gross then SSP is payable. If you do not fit this pattern you can check SSP entitlement here....livvy8448 said:

So my employer got back to me saying I'm not eligible for ssp because I haven't paid enough national insurance and that they don't know what an ssp form is. But I don't think I'm eligible for any other benefit so looks like I don't need it anyways. Thanks for all your comments0

The only version of ESA now available is for those who qualify on the basis of their National Insurance contributions in the latest 2 complete tax years. If the OP is a student they almost certainly will not qualify, but do need to check.

Your manager may not know about these things, but whoever is responsible for running the payroll should be aware!
