Deed of Renunciation

Recently I was appointed as an Executor along with another family member and currently going through the process of obtaining the Grant of Probate.  Wishing to give up their position as an Executor, the family member I believe has recently signed a Deed of Renunciation form and sent to a Solictor.  The issue I am having is the family member is being rather unco-operative in suppling any information of this process and has informed myself  that as I am now the Sole Executor it is my role to chase the Solicitor to get the Deed of Renuniciation document sent to myself.  The Solictor in question has been unresponsive to my requests and I have advised by many that as I was not the one who instructed the process, due to the Data Protection Act they can not provide the Deed of Renunciation form or information regarding this. If this is the case, how do I go about in getting this document as I am now unable to go any further with getting the grant of probate?

  • How far into the probate process are you? Executors can’t renounce if they have already taken an active part in the probate.

    Assuming it is not too late to renounce then you declare this on form PA1, which needs to be submitted along with form PA15 signed by the renouncing executor and witnesses. A solicitor is not required for this.
