Reclaim care home fees

My local council eventually contributed something towards my husbands care home fees. Now he’s dies can they try to reclaim their share if the fees even if there is nothing in the estate?

Hi.Sorry for your loss,and welcome to this forum.
Similar circumstances with us,our Mum was in care,and when her savings went down below the threshold level,the council supported her,along with her pension,and top up fees.She passed away in September.Her property was exempt as my disabled,elderly sister still lives there.
As far as I know,the council will not reclaim the money they paid out,at least,no mention of it so I don't think you need to worry.You could always contact citizens advice,or a specific care fees advice line.Or the adult social worker who would have been involved in all his care.0 -
If there is nothing in the estate, then there is nothing to give them if they claim.0

The local authority will have completed a financial assessment when he first went into a home, they would only Perdue an executor if the estate contained more assets than were declared for that assessment. In this case it is clear that he had minimal assets so that won’t happen.0
