Faulty TV

There isn't a time limit to seek a remedy with the retailer, other than 6 years to file a legal claim in England and Wales whilst considering the expected lifespan of the product.
Within the first 6 months it is taken the goods didn't conform to the contract, after 6 months it isn't taken as such so if the retailer requests such, or isn't being helpful, typical advice is to demonstrate that the goods did not conform, usually in terms of durability. This is commonly achieved by having an independent TV repair company inspect the TV and give a report on what is causing the fault.
If the report shows the issue isn't down to owner misuse or damage go back to the retailer to request a remedy.
The retailer should replace or repair the goods, if they are unable to, refuse or it would take too long or cause significant inconvenience there is the final right to reject for a refund or the right to a price reduction to retain the goods and accept their faults.
When rejecting after 6 months the refund can be reduced to account for ownership.
Simply put if AO won't help have a TV repair company inspect and write a report, if that's in your favour go back to AO to ask for them to sort out the problem and cover the cost of the report
Just to add the Toshiba warranty is in addition to your consumer rights so are simply covered by any terms given. In the game of chess you can never let your adversary see your pieces0 -

So how long is he warranty with Toshiba,it will vary with different retailers.Does not make sense .One warranty from the manufacture Toshiba not the retailer .Usually a manufacturers warranty is the same for every retailer who sells the product .It is the major problem for Consumers with a fault that they do not know the difference between a warranty and their consumer rights .often misled by the bloke down the pub or a bod on a forum and often the retailer as well .0 -
Having spent many years in the tv industry i can assure you the retailers warranty are not all the same.
Thats why people go to John Lewis or Richersounds for the FREE 5/6 years warranty.
You need to pressure he retailer not Toshiba.0 -
I don't think you read what JJ was saying. You are calling it a retailers warranty, JJ is referring to the manufacturers warranty. Manufacturers warranties are generally the same regardless of the retailer. Retailers don't all provide a warranty, but some like John Lewis and Richer Sounds offer long and comprehensive ones.mobileron said:Having spent many years in the tv industry i can assure you the retailers warranty are not all the same.

Pressuring the retailer is not the answer - the answer is as per lunatics post. The OP will need to commission a report to prove the fault was inherent and then go back to the retailer. The retailer does not need to do anything and won't buckle to pressure unless there is a report backing this up.1 -
Yes unfortunately so many retailers within the TV industry still try to evade Consumer Rights either through ignorance or deliberately .

Yes but thats because they don't need to do anything and they know it. They will pass you off to the warranty provider and hope thats the end of it.JJ_Egan said:Yes unfortunately so many retailers within the TV industry still try to evade Consumer Rights either through ignorance or deliberately .
After that it's us who need to force them if consumer rights are approptiate.0 -
Are u aware that major retailers will often take a discount of 2% to buy out the makers warranty and cover it themselves.

Does not matter if its the makers or the retailers warranty , its not the law .These major retailers are not know for abiding with Consumer Laws over many years .Many many posts on here confirm the facts .0
