Section 75/chargeback if partial refund

Ordered some personalised pjs (over £115) direct from a small business and payed by credit card. My order has not arrived after waiting the required time of the seller. 

They originally said they would refund me if I hadn’t received it by today, but now saying they can resend half my order and refund the other half. 

That is actually ok with me (as the other half was for the grandparents anyway), so I agreed. But I asked if they can guarantee I will receive it before Christmas, they answered “yes as long as you don’t have the same issue as your first order”, which is sending alarm bells.  

Currently, I believe I can either do a chargeback or section 75 claim. 

But if they refund the other half of my order and then I don’t receive the replacement order, will I lose my right to claim a  chargeback or do a section 75? (After the refund, my order amount will no longer be over £100).

Any advice and fast would be really appreciated

  • I did a chargeback against a t-shirt firm who never shipped my product, I was able to choose what the refund value was. I'd assume you could still do a part refund chargeback

    Section 75 only applies to items valued at over £100, not the total order - if your order is divisible ("the other half was for the grandparents anyway") into sub-£100 items then you don't have s75 coverage on these, although chargeback has no such stipulation....

    A refund goes on the debit amount on your statement. Unless it is a partial chargeback & then it will go against the amount you did not receive, but you have to have proof of item value.

    Sure but if I pay £200 for two brand new items of £100 each that's proof of the value. I can claim the £100 for the 1 item I didn't receive

    So long as you have a invoice or order showing what was purchased & value. Yes.

    You can't simply say I want £100 back as I only received 1 item without proof 👍

    I did with the t-shirt company lol

    I had evidence of my emails and their contact email bouncing back but bank never questioned it and firm never complained - I did think they might when they sent a dispatch email about a week after I did the chargeback but nothing ever turned up
