Credit/Debit Card Disputes for Items Not Received.



I need to make a claim for a few things but there are a few factors that make the situation a bit more complicated.
One is a signed photograph that was ordered more than a year ago. The company have been claiming for months that it’s right on the verge of being sent but this never happens. Many other people are having similar problems. This was ordered on a credit card which has now been cancelled though, and I’ve moved house, so if a refund is sent to the cancelled card and they send a letter to me about it, I won’t receive it. Is there a way to resolve this in the event that a) the company do eventually refund me and it goes to the cancelled card, or b) am I able to make a section 75 claim on the cancelled card?
Second thing is tickets for an event from the same company. Event was meant to take place July 2020 but it got postponed a couple of times. The company issued vouchers to be used at a future event and kept refusing cash refunds to people, stating they weren’t obligated to refund. I was automatically issued vouchers for several tickets, which seemed fine at the time as I intended to go to an event in the future, so I used part of the voucher funds for entry tickets to next year’s event. I’ve now found out that their statements conflict with consumer rights, and I should be entitled to a refund if I don’t want the vouchers. A lot of people have been raising disputes with their card issuer to get their money back. The shady practices of the business has put me off wanting to be associated with them at all, so I’d rather have my money back than the vouchers. The original purchases were more than a year ago though, some on the same credit card mentioned above, and some on a debit card that expired and the bank issued a new one. I haven’t formally requested a refund yet, but when I do, I expect the company won’t be forthcoming and they certainly won’t be helpful in resolving any issue relating to the cards no longer existing. Same questions as above – What will happen if they refund the discontinued cards, and will I be able to do a chargeback for the debit card purchases after all this time?

In theory you can still launch an S75 claim - and it won't take 5 minutes to call them and update your address.
Any refund will be held by them in a 'holding' account, you'll get communication telling you as such once you've updated your address and you can then ask them to bank transfer the amount to your current account.
If for some reason you don't want them to have your new address, it'll be a lot more convoluted.1 -
Refunds on a cancelled credit card just get moved to the new card. On a debit card it works slightly differently but will still get to your bank account. They just go to a internal account and moved to the correct bank account.
You only have 120 days for a chargeback (from date of event, up to a max of 540 days from date of the debit) Given you have had a voucher, there is no chargeback right.Life in the slow lane1 -
