PCN from Horizon Southall

ON 24 Nov, I went for shopping at Southall Quality food (9.34 am) and paid the tickets. After shopping I reimbursed the 2 pounds paid ticket (shopping finished at 10.45 as per receipt)

my 3 months old baby was fussing so wife had to stop to feed him and took us time to find his lost hat and we left at 11.4

Now Horizon sent us PCN for over exceeding maximum stay period on 2 Dec and reached me on 4 Dec

I have drafted below response reading previous thread  please help and suggest

Re PCN number:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date  

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it. (shall I include this as pictures of car is provided)

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

I will add  name & address of keeper here without mentioning driver

Also, in order to resolve the dispute, attach copies of purchase receipt from Quality food for 95 pounds that day showing a genuine customer

 Your Parking Charge Notice and Notice to Keeper are non-POFA and, as a result, the keeper cannot be held liable.

Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

I was 1.08 hours late and didn't write to my local MP or Soutall MP.   Is this a good idea and does it help?

That is not a non POFA PCN.  Horizon must have changed their NTKs in some cases.

Don't send a template.  Appeal as driver telling them exactly what you told us and attach the receipt.

I would like to challenge the issued PCN with a genuine circumstance

We went for shopping at Quality food on 24 Nov 21 at 9.34 am and paid for the parking ticket as per parking tickets instructions.

I am attaching the receipt of £95.93 for 24 Nov 21, which shows me as a customer of Quality foods and I got reimbursed the ticket amount of £2.00. Also mobile bank statement showing deduction of the amount

However due to current covid situation we took longer than expected time and later just before leaving our 3-month-old baby started crying so wife had to stop & feed him, also later realised his hat was missing so went back to the store to check for the hat.

Overall this took us longer than the stipulated time and hence would like you to consider waiving this PCN

For security concerns am not attaching a pic or proof of baby with us, however if you need will be willing to share.  

I spoke with the manager at Quality foods and they have suggested sending you the copy of bill along with explanation

If they do not cancel complain to your MP and Trading Standards.  Obviously, the time allowed was inadequte.
