Section 75 for solar panels

Hi, can anyone offer any advice, please?
We had solar panels fitted by a local company here in the North East five years ago, and took up a finance agreement with Ikano Bank for about £10,000, payable over 10 years. 
In June this year, 2021, a fire broke out in our loft, caused by the battery that came with the panels.
Thankfully, we noticed the fire quickly because the electricity tripped, and the fire brigade extinguished it before it spread to the rest of the house.
We had the panels taken off the roof within a couple of days by the company that 'took over' the solar panels company we bought them from, as we discovered the original company had gone into liquidation a few months previously.
The insurance company thankfully are paying for a new roof and redecoration of the landing, as well as the cost of the solar panels system. 
Understandably, however, the insurance does not cover the fees or interest charged by Ikano Bank over the 10 years, which amounts to around £3000.
I am happy to pay off the balance of the £10,000 loan with the money given to us by the insurers. However, I don't believe I should have to pay the £3000 fees/interest to the bank, since under Section 75 of the Consumer Credit Act, they are jointly liable for the solar panels.
Am I right to ask Ikano Bank to refund/let me off the £3000 fees/interest?
I have repeatedly tried to contact Ikano, both in writing, by email and by telephone, all without any response, and am still paying them £105 a month so that they don't blacklist me.
Any advice would be appreciated! Thanks.

  • No. You would use s75 if you believe you did not get the product ordered. It's not about writing off interest.
  • I see, thanks for your reply. When I contacted the HICS consumer advice line shortly after the fire, she advised that Section 75 meant the company was liable for the solar panels, so I assumed that would include the fees they charged for the loan.
  • No. S75 simply means you have the same rights against the lender as the retailer.

    Your insurance is covering all your losses, they are renewing the solar panels so you are back to square one.

    In reality you are still paying for your system, why do you expect a refund on the interest payments? Your contract is not up until you finish the finance, do you really expect all your interest back?

    Whilst it's true the CC is jointly liable your insurers have provided the remedy, it's one or the other you can't get multiple payouts.

    You really can ask for anything you like, what's to stop you? Whether or not you'll get what you ask for is another matter altogether. 

    But I would always have a go because it doesn't hurt to try and if you don't, you won't ever know. [And you MAY actually be able to get multiple payouts.]

    OP is not going to get a section 75 refund for panels when he's had them, had the benefit of them for X years AND is getting them replaced under insurance. S75 is not house insurance, it is there to cover losses where the situation cannot be resolved in other fashion.

    Also, think logically, OP cannot have his cake (get a refund) and eat it (keep the solar panels)

    I would not like to be OP when finance co, find out that insurance company have already paid out to replace them. As that may be their 1st resolution offer.
