A Shade Greener Free Solar Panels

Has anyone been down the legal route fighting against the miss selling of the free solar panel rent a roof scheme
Any information that could speed things up would be greatly appreciated
We signed up for the scheme back in 2012 after a salesman did the hard sell on us showing all the positives never mentioned a negative
So our deal was fine think we saved about £150 a year and thought all was well, then we were thinking about an extension so contacted ASG to ask about removing panels
to re roof house we was quoted 18 months for the free service as per the agreement, however if we wanted to pay for scaffolding and also put a £3,000 deposit down we could have it done within afew weeks............our first what the hell moment.... didnt bother plans went on back burner
then last year thought sort out our finances and remortgage through a broker, several companies latter no offers came in the broker pointed out that ASG had a deed over our roof space that puts off prospective buyers and makes lenders less willing to lend
I could not belive this was now costing us thousands and delaying our life plans
we got really annoyed we realised how this deal had been miss sold to us
we want to make decisions over our own house
what we do to the roof and when ..........
if we knock it down to build a new house or anything and these dam panels are now stopping us
So am going to war with ASG one way or another they are going, if I fail every other route the mortgage company can re possess and get them removed but thats a last resort but alot cheaper than paying money to asg
So switched the panels off and ASG maintaince contacted me to check system
i told them no thank you so they threatened to take out court order to access property......am still waiting hopefully will get a chance to appear at court and state why am denying them access
either way think its going to be a long battle
but if anyone else has been similar route let me know any tips
i can say for fact they won't get another penny off the panels or me
thanks
Simon

You need legal advice. Does you home insurance come with it?
Cutting then off and going to court will cost you a lot of money. You will have to pay their legal bill because you have no legal basis for doing that.1 -

Unfortunately, that's not how courts and the law works.
If you go to court just to have a rant about the solar panel company having mis-sold to you, the judge is likely to get angry with you for wasting the court's time - and come down harder on you.
If the solar panel company ask for a court order, the court will just read the lease. If the lease says you have to give the solar panel company access to your roof, then that's what the court will order you to do.
Then, if you still don't grant access, you would be breaching a court order and the court might fine you. And if you keep refusing to grant access, ultimately the court can send you to prison.
Alternatively, the solar panel company might decide to sue you for their losses.
You need to find a different way to fight your battle.3 -
Do they need internal access to your property or just external access?Read the contract, how long is left on the lease? What other rights do they have? You don't want to do something now that further hurts you down the line.Is there a termination clause in the contract at all?May you find your sister soon Helli.

I assume that before agreeing to rent your roof out to a third party you 1) Read the lease you were signing. 2) Sought legal advice. 3) Discussed with your current mortgage lender?
As others have said, the lease gives them the legal right to access your property for maintenance and the feed in tariff.
You may want to reconsider your whole 'they won't get another penny from me' stance. They will pursue you for their loses.
If this ends up in court, it'll end up costing you a lot more than however much it'll cost to have the lease amended to satisfy a new mortgage lender/buyer.1 -
mis bought rather than mis sold. You caved into the salesman and didn't read the Terms and Conditions??
You will lose if you take them to court. Cutting off your nose to spite your face it seems. If you ever need something from said company they will now make it difficult for you and good luck dealing with their queries in a timely manner."It is prudent when shopping for something important, not to limit yourself to Pound land/Estate Agents"
