TERMS AND CONDITIONS for Kiss / SKY Glass / ONLINE ” (the “Competition”).

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

 

1.Entry ROUTES and Costs	Entries are restricted to one entry per person.   There will be one competition daily on the Kiss drive time show between (16:00 - 19:00), Monday 6th December  – Friday 10th December 2021.    Entry to the Competition is available via the following routes:   (A)     Online at https://planetradio.co.uk/kiss/competitions/    Online entry is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	There will be one (5) winners of the Competition.   The competition is split into 2 phases;   Phase 1: Pre-Registration Entrants should answer the question on the competition page and pre-register their details for the chance to be short-listed as a finalist and brought to air to take part in phase 2 of the competition. Pre-registration opens from XX on Thursday 2ndDecember 2021 and closes at 2pm on Friday 10th December 2021. The draw to become a finalist will take place at 2pm on the day of the competition. If you are not chosen as a finalist but have answered the online competition correctly, your entry will roll over to the next day and you will remain in the poole of potential finalists.   Phase 2: The On Air Head to Head  All correct entries from Phase 1 will be pooled and 2 finalists per day will be chosen by electronic random draw to take part in Phase 2 which will involve them coming to air during the drive show on KISS from 1600-1900 daily Monday 6thDecember to Friday 10th December 2021 “the promotional period” and going head-to-head in a competition round.   The competition mechanic is as follows; Each caller has the same buzzword “Hello SKY”. When the presenter asks the question, and gives the options, the caller wishing to answer must shout their buzzword “Hello SKY”. Once the producer has advised who said the buzzword, one caller will be invited to answer the prize. Callers must wait until the last answerable option is given otherwise, they will forfeit their invite to answer and we will pass to the other caller to answer. The winner is the caller that has the most answers correctly out of 3. This in turn means the competition could end after 2 questions should one caller get the first two questions correct. If both callers say their buzzword at the same time and the producer calls this, then the presenter will ask another question & so on.   The winner will win the prize as stated in [PRIZE 5.0].   Please note being chosen as a finalist does not guarantee you will win the prize.   You can only play the game once and finalists can only be chosen once throughout the promotional period.
3. ENTRY PERIOD	Entries must be submitted during the following entry period:   Pre-registration opens from 12.30pm on Thursday 2nd December 2021 (Start time) and closes at 2pm on Friday 10th December 2021 (End Time).   The draw to become a finalist will take place at 2pm on the day of the competition from Monday 6th December to Friday 10th December 2021.   However, if the winner cannot be contacted within 1 hour from the date & time of [the initial attempt to contact them], then we will re-draw until we draw a winner that we are satisfied (in our sole discretion) fulfils all of the eligibility criteria and is in compliance with these Terms.
4. ENTRY RESTRICTIONS	Open to UK residents aged 18 years or over on date of entry. Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms. Anyone who has won a Bauer competition to the value of £500 or more within the past 6 months on any Bauer Radio Brand, will not be eligible to take part in this competition nor will anyone else at their address. 5. THE PRIZE

One winner per day (5 in total) will receive the following prize (the “Prize”):   1       prize package will be awarded per day. Each prize package consists of:   1 x Sky Glass TV (55 INCH) with a Sky TV subscription for 12 months to include the following: 1 x Sky Glass TV with a Sky Ultimate TV subscription (consisting of Sky Entertainment and Netflix basic) Sky Sports & Sky Cinema subscriptions and  Ultra HD and Dolby Atmos pack subscription included. Prize winner has a choice of 5 x Sky Glass colour finishes, subject to availability. 1 x Customisable speaker fascia. Prize winner has a choice of 5 x colour finishes, subject to availability. 1 x Sky Stream puck with a Whole Home subscription for 12 months Prizes are non-transferable, non-refundable and no cash alternative will be offered.   The Prize is provided by SKY (the “Prize Provider”). We are not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions. Sky shall not be held liable for any claims arising from the supply of any element(s) of the Prizes which have been sourced from third party suppliers.   *Please note that due to the current Covid-19 situation, there may be delays to delivery and to the winners being contacted by Bauer Media. These may exceed the 28 days delivery period as stated in our General Terms and Conditions.     ANNEX 1: SKY OBLIGATORY TERMS The Promoter shall administer the Competition and allocate the Prize as follows and shall ensure that the Competition Terms and Conditions shall contain terms that give effect to the Prize Conditions set out below.  The Promoter shall ensure that all entrants to the competition are notified of and accept the Prize Conditions before entering the Competition and again before accepting a Prize.   The pre-registration element of the Competition shall open at 00:01 on Wednesday 1st December and close at 14:00 on Friday 10th December 2021. The on air element of the competition will end no later than 19:00 on Friday 10thDecember. No purchase necessary. 5 competition rounds will be held across KISS from Monday 6th to Friday 10th December. There will be 1 competition round each day from Monday 6th to Friday 10th December during the KISS FM Drive show (16:00-19:00). The entry mechanic is as follows: Listeners will need to register online via KISSFM.co.uk for the chance to be brought to air to compete head to head with another listener,  to win a prize package. There will be 2 entrants bought to air per day.     This promotion is open to residents of the UK aged 18 years or over only. Proof of age may be required.  The Competition is not open to employees (or family members of employees) of any Sky UK Limited (“Sky”), companies associated with the Promotion and all affiliates of such companies.  The Promoter shall allow one entry per household only. A maximum of 1 entry per person over the Promotional Period. Entries sent in through agents, third parties websites or multiple accounts will be disqualified. Only one Sky TV subscription can be provided at an address.  If the winner is an existing Sky TV customer and has Sky Q or Sky+, they will need to take a TV subscription for Sky Glass.  We will bill the winner for their existing Sky TV subscription until the Sky Glass TV subscription is activation.  Sky Q cstuoemsr will need to send back their Sky Q boxes within 60 days of receiving Sky Glass otherwise they may be charged a non returns charge.  Third party subscriptions not paid for via Sky but viewed on Sky Q or Sky + will not be viewable on Sky Glass.   Recordings on Sky Q or Sky+ will not automatically transfer. If winners have Disney+ or Spotify via Sky, these will not automatically transfer to Sky Glass and winners will need to sign up directly to each via Apps Marketplace on Sky Glass. For 12 months, the winner will get their Sky TV subscriptions via their Sky Glass TV for no charge.  Sky Ultimate TV via Sky Glass is provided on a monthly rolling contract and can be cancelled at anytime on 31 days notice.  Ending your Sky Ultimate TV subscription will end your offer period.  After your 12 month offer period, all Sky TV subscriptions will become chargeable at their then standard price, unless you change or cancel your package, giving Sky at least 31 days’ notice. Standard subscription prices may change. Please refer to www.sky.com for current pricing. You must be over 18 and resident in the United Kingdom, Channel Islands or Isle of Mann to win this Prize. The Prize does not include:                                                 i.     A broadband subscription.  All content via Sky Glass is streamed so you must have broadband of at least 35Mpbs to use all the elements of this Prize;                                                 ii.     Sky Box Office, Sky Store purchases/rentals, Stand-alone Premium Channels, or pay-per-view services and events all of which if offered via Sky Glass will be chargeable at the current standard price Sky Stream puck and the Whole Home subscription will allow you to watch Sky TV on another TV  with a compatible HDMI port.  This is included as part of the Prize.  After 12 months, the Whole Home subscription will be charged at the then standard price unless you cancel it.  The Whole Home subscription is provided on a monthly rolling contract and can be cancelled at anytime on 31 days notice. Cancelling your Whole Home subscription will mean your Sky Stream puck will no longer stream any content. Prices, programmes/channels are subject to change.  If you do not activate Sky Glass within 14 days of receiving Sky Glass, we will automatically activate it for you and your Sky TV subscriptions will start from activation. Winners must redeem the prize within a year. Winners who are in a current pay-TV contract with either Sky or another provider may defer their Prize for a maximum of 12 months from the date of winning.  If a winner does not redeem his/her Prize within 12 months from the date of winning, this could result in loss of the Prize.  If the winner has a previous uncleared debt with Sky the winner will not be able to take up the Prize until this debt has been fully cleared.   There is no cash alternative to the Prize or any element thereof and unless agreed otherwise in writing the Prize is non-refundable and non-transferable. Sky reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that Sky reasonably regards as inappropriate, offensive or unlawful. Sky Glass delivery currently average a 40 day waiting period Prize winner has a choice of 5 x Sky Glass colour finishes; Ceramic White, Ocean Blue, Racing Green, Dusky Pink and Anthracite. Prize winner will need to confirm colour preference upon acceptance of the prize.  Colour stock is subject to availability and may result in a longer waiting period. Ultra HD and Dolby Atmos pack required to watch Sky content in UHD/HDR and Dolby Atmos.  Not all content available in UHD and/or HDR. Content must be optimised to watch in Dolby Atmos. Netflix basic is included as part of the Sky Ultimate TV subscription and allows viewing in one screen in SD.  Netflix terms of use apply. 55” Sky Glass has an energy efficiency rating of F on a scale of A-G.   Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from the enjoyment of the prize; and/or any postponement, cancellation, delay or changes to the prize beyond the Promoter’s control; and for any act or default of any third party supplier.      By entering the competition, if you are the winner, you agree that you and your guests (if applicable) agree that Sky may make your full names and counties available and may use your full names, counties and photographs for post-event publicity purposes without your permission or paying you anything.  You further agree and agree to procure that any guests agree to the use of your names, images and any video or voice recordings of you or your guests (if applicable) in any media in, perpetuity, as Sky sees fit.  You agree and agree to procure that your guests agree that the copyright (if any) and all other rights title and interest in and to any contribution by you or your guests shall vest in and be irrevocably assigned to Sky   Sky reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that Sky reasonably regards as inappropriate, offensive or unlawful.   By entering this promotion and choosing to opt-in to receive more information, you agree that Sky may use your information to contact you about offers, news products and services you may like. 1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

1. MISCELLANEOUS.

 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.
