Received an item I didn't order, can I keep?

Hello,

I ordered a electronics bundle from a retailed and it got delivered.  A couple of weeks later I received another parcel that was also addressed to me with another, slightly different bundle.  The retailer has called to arrange collection to get the second bundle back however am I legally within my rights to keep the goods?

Any help greatly appreciated, thanks.

No*, you're not - you already have a commercial relationship with the retailer so these were not unsolicited goods, merely an error. (You have become an involuntary bailee of the goods). The retailer is doing the right thing by arranging to collect the goods sent in error.

    * Yes - if you pay for them.

Exactly as Jenni said - items received in error and the retailer is correct to collect them (which they've already made arrangements to do).

    can I keep?

No, you can't keep but you must keep them safe until they are collected.

And to answer the perhaps inevitable follow-up question: No, you can't charge for storage.

Lets spin the question... if they had accidentally forgotten to send you the bundle[s] would you be happy if they decided to keep them?
