POPLA appeal lost - PPS ltd passed on to debt recovery- threatening court action

My letter from Gladstone solicitors, does not have reply forms enclosed. does it mean it is or is not a real LBC ?It's real right enough. Gladstones kindly offer you the opportunity to download your own from their website (which you will not be doing!).
There's no template. Simply respond stating you deny any debt to their client and any court claim will be robustly defended. You must state that you are seeking debt advice (you're getting that here!) or else they are under no obligation to provide the 30 days.
And when you get that leeway, you must use it to prepare for a claim, not see it as an opportunity to bury a head in the sand.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The first few paragraphs there explain exactly how you should react after having received a Letter Before Claim.
That second post of the NEWBIES thread should be your first port of call from this point on - right through any court claim. Please read that before asking any further questions.
2.Letter to PPC's DPO
Assuming it is a ' real 'LBC then another issue is Private Parking Solutions (London) Ltd's weblink for PRIVACY POLICY does not work. https://www.privateparkingsolutions.com/. The only contact email address mentioned is info@privateparkingsolutions.co.uk.
I have used their 'contact us' form to bring this serious malfunction to their attention. I'll let you know when/if they respond.2 -

He means, please read the NEWBIES thread 2nd post more thoroughly and also do a simple forum search for other Gladstones cases, where you would find dozens of drafted responses to LBCs this year. Literally loads to learn from in 2022 alone. The forum is a resource, like a whole library of books where half the court claim 'plots' involve Gladstones.
You don't seem as if you've read many yet and we are trying to help you (but we won't do the search for you because that doesn't help you).
When you use the search function change 'best match' to 'newest' to avoid reading years-old out of date stuff.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

After literally months of silence, received a letter from Gladstones Solicitors date 26 July 2022, "LETTER BEFORE CLAIM" on behalf of Private Parking solutions (London )Ltd and amount due £170" . they are threatening legal proceedings if debt is not paid within 30 days of £170 . letter also says refer to the pre-action protocol (the PAP) and the practice direction for preaction conduct contained in Civil procedure rule ('CPR').
Given me 3 choices within 30 days
- pay the debt
- dispute the debt . via reply form
failing that there is a warning saying their client reserves all its rights, including the right to commence court proceedings, which will incur further cost and interest ,, there is table published later amounting to £285.
Please could someone advise best course of action now. do i duspute this on their website? what if they start court proceedings?
Right now, you have a 4th option under PAP and that is when you reply asking them about the fake and their legal authority to add this, tell them you are taking debt advice and to allow you a further 30 days
Gladstones have never given a reason for the fake, there is no answer.
If you get a court claim which they must sign as a statement of truth, they have a problem ...... it will be a lie if they add the fake
Most judges will not allow the fake or interest .... and as they do spank Gladstones, you can claim your costs.
If you get a court claim which is possible, come back so this forum can help you to zap them0 -
This is explained in the other Gladstones threads that I suggested you need to read. It is nothing special or different.
It's not a different option, just a more robust way to respond and examples are literally all over the forum for want of a search. Just put in the words Gladstones LBC and change the 'best match' default to 'newest' and look back as far as at least April. I wrote several robust replies on Gladstones LBC threads in April.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

i have gone through several posts, it appears there is significant amount of time required to 'gather evidence' and preparing robust defence ahead of court date. including things like visiting the place where ticket was issued, taking photos , several forms that need to completed and so on.
I am reconsidering my options and thinking of paying Gladstones.
I will hate doing it but I am going to spend at least 2 days of my life doing the leg work for avoiding paying £170.
Are there any disadvantages of doing this or matter will be closed completely?

the only counter argument is you cant put a price on defending your rights and standing up to bullies. which is fair argument. And the other argument is you develop some useful investigative and defending yourself in court 'life'skills..1 -

the only counter argument is you cant put a price on defending your rights and standing up to bullies. which is fair argument. And the other argument is you develop some useful investigative and defending yourself in court 'life'skills..To be honest, you’ve come on looking for advice and it’s been given to you. If you want to ignore the advice then that’s your prerogative but I would just state that these people know what they’re talking about so you should trust them. It may mean some work on your behalf but in this day and age , are you really just going to throw away £170 without standing up for yourself ?3 -
There is one physical paper form to fill out, a N180 Directions Questionnaire, that asks which is your preferred local court and which days you are on holiday that should be avoided for a hearing date.
All the answers to questions in the N180 are shown in the Newbies thread 2nd post and it takes about 15 minutes to fill in.
I've already written 95% of your defence for you (see Template Defence thread) and it takes another half hour max, to add your 'car park/what happened' facts, and email that off.
Another way of putting it:
By paying £170 a person is sponsoring and funding not just the parking scam against the next few people, but also funds the robo claim model and Gladstones, so they can go after more parking charge victims going forward.
Another point from me:
As the only Consumer individual co-opted into the official Steering Group about the Parking Code of Practice Act, I've been attending Government meetings in my own time since May 2020 to get the law change through and new statutory code of practice to where it almost is now. I get no expenses and each meeting has been between 1 and 4 hours each time.
During that period I also had a full time supervisory job (I don't now, but I did).
That'll be FOUR YEARS of my life dedicated to this new Code in the end, because its implementation is now delayed till 2024.
Guess whose money funded the two Judicial Reviews that bullied the Government and stopped the Code from progressing?
Yep. Victims who were sadly duped, or decided it wasn't worth their time, and who paid a scam PCN despite it being easy to fight and an empowering life experience.
Ordinary motorists sadly paid for the two Judicial Reviews and by doing so, they stopped the statutory Code of Practice and have delayed and jeopardised it. People who paid, funded that.
Ordinary motorists paid for a top ParkingEye employee to prat around like a celeb in a £160k McLaren supercar and park it sideways across 3 bays, because he/she can because no rules apply to them in their car park:
https://forums.moneysavingexpert.com/discussion/comment/79269030#Comment_79269030Victims also paid for all this:
