Help with a private parking charge and court

    These are the points so far;-

    2.       It is admitted that the Defendant was the registered keeper of the vehicle in question but liability is denied.  

    3.  The defendant was not driving the vehicle at the time the ticket was issued.

    i) The first time the defendant was aware of the PCN was on receipt of a letter from UKPC Ltd dated 14/02/2017.

    ii) The defendant replied in writing by post to the appeal postal address listed on the letter dated 14/02/2017 both appealing and requesting information from the claimant. Copy Enclosed.

    iii) The defendant outlined three points of contention in the letter dated 21/02/17. 

    iiii) The letter from UKPC Ltd suggested the vehicle had been parked at xxxxxxxxxxxxxxxxxxxxx. This address does not exist. xxxxxxxxxxxxx is a major dual carriageway which is operated by Reading Borough Council. Map enclosed.

    v)The postcode shows a small residential car park while the images obtained from the claimant show the vehicle parked on a road next to an office complex at an unknown location.  

    vi) The failure to respond prevented the defendant from investigating the matter further in particular the signage in place.

    vii) An image obtained from the claimant (from an unknown location) shows a sign which is illegible and does not meet the prominence of signage laid out in The ParkingEye Ltd v Beavis [2015] UKSC 67

    viii) No further correspondence was received from UKPC Ltd until some letters from DC Legal and a court county claim were collected by the defendant when visiting his vulnerable elderley mothers house while visiting for a family engagement

    No, not with a defence.  No attachments.

    You need to read @bargepole's court process thread, that's linked in the 2nd post of the NEWBIES thread under the red heading IMPORTANT - KNOW WHAT HAPPENS WHEN'.

    If the address the claim was served to is wrong, then you MUST separately alert the CCBC, the solicitor and the PPC to erase it and change their database.

    Also mention your correct address in point #2 of the defence, do both.

  • Thanks Coupon. I will send without attachments. Does it matter if I send now or what. Re the addresss it is the correct address on the V5 but I moved out as my mother is vulnerable and needed to shield at the start of the pandemic. although not my current address the car is still there.

    Either.  And I know the address is the one from the logbook but it is still not right for you and you cannot risk missing a Court letter.  So do as advised, separate email, copying in all three data protection officers.

  • Hi, I have received a reply from DCB Legal stating that they have reviewed the defence and intend on continuing the claim. At the bottom of the letter they have suggested contacting them to settle the matter. I previously offered them £25 to settle the matter. Is it worth suggesting this again or just continuing through to court with it? Thanks as always.
