Parking fine - Court summons

Hi all,

I'm sorry if this has been covered before but I can't seem to find anything specific to my problem.

I've read the newbies section and am just about to submit my response to claim, via moneyclaim (on day 5), but I have a problem I'm not sure how to best resolve. I've recieved 2 seperate court summons for 2 seperate vehicles at the same time. They have different claim numbers. The issue dates are the same, sent to the same address, the only thing that is different on them is that, as far as my details are concerned, my name has been shortened. The parking tickets have different dates (3 months apart) and I'm pretty sure my wife was driving at the time ... I'm not sure how to proceed as I would assume a court summons should have both parking tickets on the one claim.

Sorry if this problem has been addressed some where else and thank's in advance for any advice given

These are not summons , they are moneyclaims using MCOL

Name the parking company and any legals

Post the 2 issue dates from the 2 claim forms

    STOP... don't do that yet.

What is the Issue Date on your County Court Claim Forms?

Issue date - 24th Nov, on both

With a Claim Issue Date of 24th November, you have until Monday 13th December to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an AoS in a timely manner, you have until 4pm on Wednesday 29th December 2021 to file your Defence.
That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • Hi, thanks for the response, but what do I do about the fact that they are 2 seperate summons with 2 slightly different names on? Do i file a AoS for both?

2 separate court claims ( they are not summons , because these are not criminal matters , but are Civil matters )

You ask the CCBC and your nominated court to combine the 2 civil court claims into one hearing , if it's the same location etc

You keep asking until two become one , it's well documented on this for , it's been discussed dozens of times on here

Yes do the AOS on both , if the issue date is the same
  • Thanks Redx, for the info and correction and excuse my poor terminology. I'm much better at hitting things with hammers then I am with words!

Should I go ahead and submit the AoS and then ask the 2 to become 1, and if so or not, should I do it by phone, email, post or is there a section on the AoS forms that I can use.

    Many thanks
  • Sorry, missed your final sentance some how.

    Do both AOS

Mention amalgamation in both defences in a few weeks time , plus when you write to your local nominated court in several months time

Read a few defences on here , especially the discussions about amalgamating multiple claims , see what they wrote and did
