Thank you everyone.. BTW - i also explained the situation over phone and requested the hotel reception team to see if they can cancel the ticket and they have written to Parking Eye to see anything can be done on this.
Its been 4 days but we havent heard back from them. I had sent a reminder to hotel as well to see if they can chase up with Parking Eye. Going to give another 24hrs before i submit my defence.
Should i put this also as one of the paragraph in my defence stating that the hotel tried their best to contact Parking Eye? Any thoughts / suggestions.1 -
Yes add that the Hotel want the entire parking charge and claim cancelled and are horrified at the idea of patrons being sued. As such, there is clearly no legitimate interest or commercial justification to support this case and the completely different ParkingEye v Beavis Supreme court case is fully distinguished.PRIVATE 'PCN'? Update: Parking eye has come back to me with a letter saying They want to reduce the charges from 185 to 70 pounds and have given me 14 days to pay it. Personally i am thinking of ignore it as I am not interested in paying 70 pounds for something that is not my fault. Your thoughts ???1

If you paid to park offer them nothing. Judges are not fools, let them take you to court and let a judge decide.You never know how far you can go until you go too far.1

See if the Hotel will pay the £70 as a goodwill gesture. I would thank them for stepping in but tell them all that's been offered as a result of their contacting PE is the attached, not cancellation, and you are not happy to pay a penny because none of this was your fault and you believe Hotels should think twice before using the likes of ParkingEye.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
