Hi, in June 2020, I took out a 3 year contract for my 14 year old daughter with Tesco Mobile for an Apple iPhone 7. The iPhone has now just stopped working after 17 months, there is no damage to the phone. I was informed that the warranty ran out after the first year and as I had no insurance, I am liable for the repair, if we decide to go ahead. I wasn't aware when we started the contract that the warranty was only for 12 months, it may have been in the terms and conditions that you sign, but to be honest you have to sit and read pages and pages on a screen in store and then sign it, I didn't read it word for word, just scanned through it, like a lot of people do. I wasn't verbally given this information, if I had been then I would have taken out the insurance. I have spoken to Apple and they have informed me that their is a Consumer Law that covers products for 24 months, which is not always public knowledge. I have spoken to Tesco Mobile about this, but they say it is only for 12 months. Can you please let me know where I stand, thank you.

  • They don't have to offer any warranty at all. If 12 months was all the warranty they offered when you took out the contract, that's all the warranty you'll get.
    How much is the repair quote? You can get a refurbished Samsung Galaxy S8 for around £130 which is roughly equivalent to an iphone 7, if not a bit better.

    Would that be the mythical EU 24 month (2 year) warranty that never existed, even before Brexit?  A 3 year phone contract will add up to several hundred pounds.  It's worth spending a few minutes reading the contract.

    Your options are really:
    1) Get an independent report to show that the phone had an inherent fault at the time it was sold to you.  That may be money down the drain unless the report shows that it was faulty.
    2) Buy a second-hand iPhone and swap the SIM.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
