Contract cancelled

Hi

I upgraded my mobile phone contract with vodafone in one of their shops, they did not have my phone in stock but said one would be delivered by DPD the following day. I upgraded my contract and signed all the documents.


Later that day i received a text from DPD saying my phone would be delivered the next day but the postcode was wrong, i contacted to vodafone 20 mins after getting the text, they changed the address and said my phone would still be delivered then next day


My phone did not arrive. I contacted them again and they said that I had to wait 3-5 working days for the phone to arrive back at vodafone before they could send it out for delivery again.


I got a call 4 days later to say they received my phone only for them to put me on hold then say they didn't have it and it was a mistake and they are still waiting for it to be returned.


The next day i receive a early morning text to say that my phone had been received by Vodafone


1 Hour later i receive a email saying Vodafone have cancelled the upgrade to my contract and restored to the old contact. 


I have since contacted them many times, the general help center and to their complaints department


The reason they gave me for cancelling my new contract that i had signed 5 days ago is “ the phone they sold me on the day  in the deal was to cheap of a price”


I signed the contract in the shop for that deal they are now refusing to give me the phone that was part of the deal, they said I can still upgrade but the new contact would be over double the price.


Vodafone have all the notes on there system of all the events, i have copies of all the signed documents from the new contract they cancelled on email/text.


I thought once I had a signed contact that was the agreement confirmed by myself and vodafone, also they still owe me the £100 upfront fee I paid


Is the phone deal worth pursuing or should just write it off?

    Do you have that in writing?  If you do it does strengthen your case.
    The only other thing to think about is how good was the deal?  Was it just a really good deal or was it a "wow, that's the deal of the century, I'd better sign up now before they realise their mistake" 

    Certainly if they don't play ball with the new contract the least you are entitled to is the upfront payment back.
  • Sounds like they made a mistake on the price, which, if it's an obvious error (and at less than half the real price, I would say it'san obvious error), they are allowed to rectify by cancelling the contract, but that means they have to return your £100.


  • Paying in the shop or signing in a shop really is the worst case scenario for your rights.
    Having read vodaphones contract in detail previously
    All you are owed is your £100.
    Issue them an invoice for the £100 and move on .
    Next time, by all means look in the shop, but go home and do the deal online.
    That way you have some protection.
