Hi everyone, we went ahead and sent comments on the evidence from the operator and it has been rejected! I am flabbergasted to be honest, had I not taken ill a couple of days later, WE were going to complain to the operators for (a) a clearly faulty machine which gripped onto our card and would not release and (b) having no-one on hand in an emergency! I am going to check out info on here to find out what we should do next. Is it too late to complain to the landowner? What happened to justice ha!0

Always , ALWAYS complain to the landowner , it's never too late , but the newbies FAQ sticky thread near the top of the forum in announcements told you this when it mentioned plan A !!
So that is what you do next !! From now on its
Landowner complaint ( Highly recommended )
Fight it in court , letting a judge decide ( the ultimate decision one way or the other , Justice )
Or pay in full ( not recommended )2 -
Get your MP to lean in the landowner, parking firm and the BPA taking up the mantle on your behalf and insistIing that the BPA investigate why their AOS member supplied POPLA with the log from the other machine only and (in your view) passed it off as evidence that the machines were working.
The BPA's Head of AOS is Sara Roberts and she sorted out a contentious issue with a faulty NCP payment system only this week, as reported on a thread. She investigated and the PPC cancelled multiple unfair PCNs for the lady.

Useful for contentious and wholly unfair cases. My main complaint would be how they appeared to be economical with the truth in their POPLA evidence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Red X - yes I came here a little too late in the process, but now getting hold of landowner details. Court it is then!

tboo - no we didn't get a ticket on exiting. We were really stressed after all that transpired, it's no lie (we're no spring chickens!). We couldn't wait to get out of there after our experience. Yes, we had photos of the card stuck in the machine and submitted with our evidence. Had a copy of my husband's phone log to show 3 calls to bank and call to first number we tried to speak to someone which was the payment line. The calls to Security was from my phone and sadly were not on my phone call log, must have deleted before ticket.
I will keep you all posted of progress and thanks again

By the way coupon-mad, when I checked the call log carefully (before commenting on the evidence) ALL of the payment times on the log were outside of the time period we were in the car park.1

Well! We've seen that before as well. Point it all out to your MP and get them on the case to the BPA to give your complaint more weight. Emailing Sara Roberts direct in a case like this is the right step to take.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
