Confirmation in Scotland
My father has passed away leaving me the executor. The lawyer wants a fee of 5k upfront for the paperwork.
However I've contacted all the banks etc and set up an holding account for monies until confirmation is granted.
I was going to process the paperwork myself. C1 is straightforward but when
transferring my Mums unused nil balance for inheritance tax purposes. Is the correct form C5 & IHT217? If I use them I do not need the IHT400 form?
Thanks

C5 and IHT 217 if it is an excepted estate and all of the first person’s nil rate band is available for transfer. Otherwise IHT400.
If there is a house in the estate, also ensure you have considered the potential for transfer of unused residential nil rate band. From memory, the C1 guidance note says nothing about RNRB.

You probably have this sussed but I found the information on the mygov.scot website very useful when I did a similar exercise. If you search for ‘confirmation mygov.scot’ you should hopefully find the link.
The overall process is not that troublesome, it just needs a methodical approach.

I'm not sure I've sussed it and the lawyer keeps telling me one mistake and it will be rejected but I'll have a read thanks0
