Any update information on Euro car parks Scotland

Hi.  I received notice to keeper for parking too long in a car par managed by Euro in Glasgow. Looking at information on this forum I thought to ignore the notice as advised to looby??.
I have just came accross a piece from lawyers Morton & Fraser saying that these notices are enforceable and the keeper can be taken to court.  They also mention a Ms Mackie having to pay £24000 as she had just ignored these noticrs and also kept parking in the car park.  Does anyone know of any update to the law in Scotland and whether I should just ignore the letters?

    Carly was a serial parking infringer who followed bad advice, so the claim against her was worth pursuing. If yours is a single PCN (and you've ignored everything, so they don't know who the driver is) then there's not a chance in hell of the PPC trying court action as it would cost them far more than they could recover, and they'd not get any costs back.

    i.e. the law in Scotland has not changed (yet).

    We don't advise parking against T&Cs at all - just that PPCs tend to use dubious tactics hence why we help people.

    I believe Ms Mackie declared herself insolvent and the PPC got nothing. As Jenni said, Carla parked where she shouldn't and kept doing it over and over again, and the PPC identified her as the driver.

    Nothing has changed yet in Scotland. A vehicle keeper cannot currently be held liable for a parking charge from a private company.

    Do be aware that when the supporting legislation for the Transport Bill (Scotland) comes into force (probably next year), vehicle keepers will be liable in Scotland, even if they were not in the vehicle at the time of the alleged event. It's a ridiculous law we have had south of the border since parking companies lied to our government and convinced them it was a fair thing to do.

    Your dear leader is a hypocrite to say she wants independence from the rest of the UK yet has openly welcomed and introduced one of the worst English civil laws ever written.

    Next year, yes.  Not retrospective but get ready for a tsunami of chancer PCNs from new PPCs north of the border, and then reports of motorists being sued to within an inch of their lives, as PPCs make hay, due to Scotland taking the (frankly stupid and unnecessary) decision to copy the badly drafted and dangerous power of the POFA's keeper liability:

    Timeline above (yes, it applies to Scotland too).  Luckily there will be safeguards, most notably a proper appeals service.

    Good points @Coupon-mad ... the only thing I'd add is that single PCNs are still unlikely to be pursued in Scotland due to the nature of the Simple Procedure (serving of documents) and the fact that no costs are recoverable for claim values under £300. :)

    I wouldn't put it past PPCs to issue two PCNs for one event such as failure to display a PDT ticket, AND an overstay. Then they would add on £60 - £70 per charge for fake debt recovery costs, and bam, it's now over the £300 threshold.

    Whilst that's possible I suspect that a Sheriff would give the claimant short shrift when the defendant brought this to their attention. :)
