Paying excess when it’s wasn’t my fault

But I have claimed from his insurance but they’re saying I haven’t when I’ve actually did! She’s lying and I know she is. He said to me and my husband on the phone if it’s 50/50 we would have to pay but the third party has taken full liability! He never said on the phone about excess if he did we would of saved of it0

Send a claim to the third party's insurer for the £350 as an out of pocket expense from the accident.

I had an accident that was No my fault.
I needed my car fixed and Zurich my insurance company said if I paid the excess now car would be sorted the same week.
They would claim it back from third party.
Which they did and luckily it came 2 weeks before renewal.
I must admit I was with Hastings direct about 8 years ago and would not touch them with a barge pole.1
