EuroParks fine for innocently entering wrong car reg
Willawoo5
My appeal to Europarks has been rejected, even though I sent evidence that my usual car was in Kent for 2 days on the date I was fined. I had borrowed my brother’s car, paid for parking on the parking app but completely forgot to change the car details. They state there was a “major keying error”, which I freely admitted. But I still paid for parking - albeit in the wrong car. So they are not out of pocket. Is there a template letter I can use to write to appeal toPopla for this situation - I can’t seem to find one on this forum that would fit thesecircumstances.
Many thanks

Are you sure it's europarks ?
Surely it's Euro Car Parks , ECP !
If it's a keying error , they should have offered a £20 offer in line with the BPA CoP , so did they ?
Do you have a POPLA code ?
POPLA appeal advice is in the 3rd post in the newbies FAQ sticky thread near the top of the forum in announcements , no idea how you missed it
There are no templates , but the Popla decisions sticky thread near the top of the forum contains examples of winning appeals1 -
Did they offer to settle at £20? That is the best you will get unless the landowner will cancel it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Coupon-mad I'd agree insofar as that's what the BPA recommend amongst others.
But there is some non binding case law. The question of no loss is, I think, viable where payment is made in full with no impact on the provider (its not the same as the beavis no loss point) http://nebula.wsimg.com/bae7471710c27d4d03bc22c4486bd258?AccessKeyId=4CB8F2392A09CF228A46&disposition=0&alloworigin=1
And the technical consultation appears to suggest (para 27) that there should be a nil charge in the tariffs unless I misread that?

Some judges regard this as trivial, read this

Have you read the newbies and complained to your MP?You never know how far you can go until you go too far.1 -
Thanks all for your replies - yes it is Euro Car Parks, I'm afraid I was multi tasking and typed it wrong. I will look into all of the above and have another look at the newbies thread. It seems I misunderstood the letter about the £20, so yes they did offer it andI have decided I am going to pay it and be done with it as I have too much going on to appeal it. But this is such a great site for advice, I will read all properly. Thank you .5

BTW, It is not a fine. It is an invoice for compensation for the alleged harm they suffered when you allegedly breached an alleged contract, You owe the nothing unless a judge says you do.
It is all explained in the newbies, which should be read by everyone.
