long story short

I booked a hotel in Japan for September last year our flights were cancelled and refunded 

The hotel agreed to extend the booking by 18 months. I went to rebook but the hotel is know closing for good and i would be refunded. I asked if i could be refunded directly and received this reply 

Thank you very much for your reply.

 

We are sorry but we already refunded to Agoda.

 

Also, we handed over the refund list and ask them to proceed the refund last month.

Therefore, we think they are proceeding the refund (or there is possibility that they will proceed the refund once our refund appear on their account.).

 

If you would like to receive the refund as soon as possible, we recommend that you contact your agent as they may be able to  give priority to the reservation that the guest request a refund.

I cant get a reply from agoda is it worth trying with my Credit card

    When did you contact Agoda? Have you given them enough time and what does your online account booking with them now say?

    I only seem to get auto reply emails from agoda as far as my online account shows the booking was completed

    There is a timeframe (which your bank should have given you) between a company promising to do a refund and it appearing into your balance, if it goes beyond this then its a valid dispute you can raise with the bank.

    What would be the legal or regulatory basis for that, and specifically what sort of dispute are you referring to?

    Neither section 75 nor chargeback operate in that way (they inherit timescale obligations from the contract, and surrounding legislation, governing the relationship between customer and supplier), and in any case OP hasn't heard anything from the company who will need to be refunding him, just that a third party claims to have refunded the intermediary....

    Well I can see S75 rejected as 3rd party booking site used. Even if hotel has refunded them. I can see that CC will say that. 

    Who is to say that hotel have refunded Agoda. OP really needs to go back to hotel and get proof of refund (ARN) Acquirer reference number.

    Chargeback wise, tough one. But without knowing the actual payment date of the booking it's hard to say. As clearly the max 540 days from actual debit is the issue here. Despite a recent refund.
    Also for non receipt of refund it requires something in writing stating date, amount & last 4 of card no. Which would have to be from Agoda as they will be the description on the debit.
