Hi Everyone, 

I received this from our friends at DCBLegal today

WITHOUT PREJUDICE SAVE AS TO COSTS

We write in relation to the above matter.

It is our Client's position that you remain liable for the outstanding Parking Charge. The Terms and Conditions made it clear that there was a 2 Hour maximum stay on the Land, your vehicle entered the Land at 01:08 and exited at 04:01 which a stay of 2 hours 52 minutes.

Despite the above upon review of your previous correspondence, our Client would be agreeable to withdrawing their Claim entirely on the condition that you do not make an application for costs against our Client.

Should you be agreeable to the above, please respond immediately so that we can take the appropriate action to cease proceedings.

Upon your agreement we will proceed to file and serve our Notice of Discontinuance and no further action would be taken.

If I accept this, does this mean it is done forever? Can we finally put this to bed?

Yes - if you have no costs then tell them you accept that 'drop hands offer' and expect to see the Notice of Discontinuance by next week.

Please show us is the NoD when it arrives.

The skeleton argument I sent above clearly outlined similar cases previously thrown out and as I CC'd them in it looks to have done the trick here.
