Napier Parking Penalty Charge Notice

Hi MSE Forumites,
So back in July I parked in a Napier Parking car park in Truro down in Cornwall and purchased a ticket from the machine and put it on window display.
It seems I made a typo on my parking ticket because I received a fine from them some time after.
Unfortunately I never kept the ticket but I appealed to them with proof that i made a transaction that showed Napier Parking Truro which they rejected. Again unfortunately I missed the 21 days for free appeal to the IAS but have requested with Napier a non-standard appeal which I will pay for.
My question: do you think I'm covered lawfully by my proof of transaction if I am to be taken to court?
I happened to find a news article for an almost identical story too around the same time at the exact same car park:

    Don't do that - Noooo!

    By doing so, you are agreeing to be bound by the IAS decision. They are so far away from impartial that you will never believe. Only around 4% of motorists ever succeed at the IAS. 

    That move will almost certainly cost you a binding £100 plus the £15 you have paid for the 'pleasure'!. Don't go anywhere near it!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    As above, do not pay to make an appeal. You will lose and give yourself more problems for the privilege of having your pocket picked.

    If you are too late to do the free version then you are now in ignore mode unless you receive real court papers.

    What happened when you complained to the landowner?

    Have you complained to your MP yet?

  • I helped my son defend a similar case where he did not see the hidden terms and conditions signs requiring him to enter his registration number. He put in his money and the payment machine gave him a ticket with the first two digits of his registration number despite not using the keyboard at all. His appeal to the PPC was rejected and we didn't bother with the IAS as advised.

    If you feel as strongly as we did about the unfairness of these parking scams you can wait to see if they proceed to issue a court claim which with some effort you can defend. A judge might determine their claim is 'de minimis'. There are plenty of cases that show payment machines / systems do go wrong. A well written defence and witness statement may result in the PPC not turning up to defend their claim or if they do a judge can decide.

    I suggest you read the 'Newbies' thread to understand the defence process and use the standard template for cases where they add on additional charges  - usually £60 / £70. Happy to share any information to help you challenge this.

    Plus I doubt that Napier issued a Penalty charge notice , more likely to be an FCN , a private parking charge notice , in other words , an invoice

    No way should you go down the IAS paid for appeal route

    Argue your Defence in court , if it gets that far !

    Napier are not as sharp as they were when they used to run their own court claims.  On odd occasions they use BW Legal but we almost always win.  Nowt to stress about.

    Obviously keep all letters and tell Napier by email if you move house within 6 years.

    Point taken, I won't bother with the non-standard appeal. I will read up on the newbies thread you suggested.
    I hadn't thought of complaining to the landowner or MP. I'll check out both of those.

    Did you hear any more? No paying it even if they file a claim. We see off almost every case and we can help at every stage.

    Did you see the new statutory Code of Practice last month has banned add-ons because the DLUHC says they were 'designed to extort money from motorists'?
