    I agree with you and sympathise with the position you find yourself in.  The only thing I can say that is not guesswork is that eventually your correct tax position will be calculated by HMRC and all tax that has been overpaid will be refunded to you.  In the meantime I hope you are successful with your call tomorrow and get a better tax code.

    DWP will only be using a tax code provided to them by HMRC - they have no power to create or change it. HMRC wil have potentially received notification from various sources, including DWP, your pension provider(s) and any employers as to your projected income for the year, and used this info to come up with that code.
    I think it's HMRC, not DWP, you need to be querying this with. If you have set it up, you should be able to see a breakdown of how HMRC got to that code on your personal tax account online.

  • And was your ESA taxable?  I think some ESA payments are non taxable so if you only received non taxable payments that could explain the lack of monetary values on any part of the P45 DWP have sent you.

    Great answer dazed and confused. The reason for the blank values on the P45 is because the ESA is not taxable, news to me. However that makes the tax code even more strange. Aren't HMRC supposed to supply with some calculations to back up a tax code. No estination from my pension provider would come to anywhere near the values they are talking about. The pension is about £6I a year starting from july, and the other one half that from October. I'm totally confused.

    Yes - have you looked at your personal online tax account as I suggested earlier ?
    From the account page, look under 'income' 'pay as you earn'  and select 'check current tax year' and it will show you your current tax code and how it is made up. It also allows you to see what taxable income you have been reported as recieving from various sources and allow you to flag anything that you believe is wrong.

    Was that code you were on before you started getting ESA? DEP would just use with the one they had. They will have no knowledge of your current income: tax code. HMRC don’t give DWP a new code for you signing off.

    I cant set up a tax account online yet as I dont have a passport so no I'd. I have just applied for a new one. I haven't worked fir ten years due to illness so would have been on a normal tax code then. I have rung them and to be honest I'm even more confused. They have based my tax code on income I have received this year allegedly totalling £9500. I was astounded I felt deceived I've lived on benefits that's all. So mr nobody one night found the login details to my account and nicked the £9500 did he. Not likely. I asked her where this mysterious money had allegedly been attached to my code. She couldn't provide me with any details like who had paid me etc. I demanded a full investigation into this error, how this money had been incorrectly adjusted to my tac code. I asked for a new P45 she said no, and I should pass the old one to new employer. I said no I  have no confidence in them. They are clueless
  • I think you are missing the point here, a tax code is just a provisional attempt to calculate the correct amount of tax.  

    They are often calculated in the January or February before the tax year even starts so it's not unusual for them to need revising as circumstances change during the year.

    Just because a tax code has been calculated, potentially 9 or 10 months ago, using an estimate of £9,500 income doesn't mean you have actually received that or that anyone is claiming to have paid you that.

    The tax code on a P45 issued by DWP really doesn't matter in the grand scheme of things.  And HMRC definitely won't be issuing you a new P45 to replace one another organisation issued to you.

    You are getting your priorities wrong with this.

    No I was told by the person at hmrc who I contacted today that the tax code was based upon a payment made. I dont see how whether in January of whichever year since 2010 when I have only received ESA this mysterious amount of money can have been used as an estimate. I could understand it if my circumstances had changed but they haven't. I am entitled to know how my tax code as being calculated and they must provide me eith this information. I can then see the error of their ways. There is no making an estimation  in January andcorrectiong later when you haven't had anything different in ten years.
