Sixt and Avarto

Hi, thank you in advance for any support (please let me know if I have posted in the wrong forum!)

Back in January 2020 I hired a van with Sixt, I returned the vehicle out of hours in the centre of Birmingham and Sixt claimed there was new damage. Initially on the damage report they said there was a scratch 5 - 10 cm big and then on the damage quotation document they had charged for a scratch greater than 10cm (£401). I disputed this but Sixt didn't respond. 
Fast forward to October 2021, the "debt" has been now been passed onto Arvato. I have been in communication with Avarto who have raised a dispute back with Sixt. On the phone the Avarto adviser said that the file would be put on hold for 14 days whilst the dispute is raised but my credit score may be effected as Sixt may put a default on my credit report. 

My question is, can Sixt put a default on my account for credit I never actually agreed to? I know if I had taken a store card for example and hadn't paid that it would be owed credit but this is owed debt. Is there a difference? 

Any help would be really appreciated, I don't want my credit score being effected by £400.

    I suggest you read the hire contract as I am sure that you will have accepted this as part of their terms and conditions.

    (Whenever we hire a car, I photograph all sides upon collection and all sides upon drop-off.)

    Thanks! I have looked at the T&Cs and rental agreement and there isn’t any mention of effecting your credit rating etc. 
  • If there is no credit agreement, then nothing will appear on your credit files until they get a CCJ.
