Hi,
I recently posted on here asking advice about the above. I have written to the HMRC debt collecting service who are now dealing with this, they have completely ignored my letter instead sending me a letter with the intention of taking a % of my monthly wage. What I want to know is there any way of stopping this, I cannot afford the amount they are intending to take it which would have worked out this month at £250!

I have sent them another letter today telling them that I don’t think I owe this money as I did at the time this actually happened.

Did you request the SAR as advised in your previous thread? this will tell you all in the information they hold about you. https://forums.moneysavingexpert.com/discussion/6296576/overpayment#latest You will be out of time to dispute the overpayment now as this should have been done when they sent you the award notice at the time. You can ask them to reduce the payments.0

Complete an Income / Expenditure form and agree a monthly repayment amount with DWP debt management.

Are you out of time for raising official error, if the SAR info you (hopefully) requested revealed that the overpayment arose through HMRC error?

After receiving the letter from the debt dept I wrote to them saying that I disputed this overpayment at the the time 7/8 years ago. That letters were sent back and forth but now all this time later I can’t remember why I disputed it. Then I heard nothing from HMRC so believed that was the end to it. In the letter I received it mentioned none of this, it was as though my last letter had been ignored!I have sent another letter back asking why they have just ignored my 1st letter!I don’t know what a SAR is?0

Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0

Other than what has already been posted we can't really help until you take action yourself, looks like you made a half hearted attempt last time and gave up, in future keep all paperwork and make copies of paperwork that you send them, if you can't remember how you disputed it how can you know you don't owe it?
From a point of view of the £250 a month you need to do as suggested above and provide them with income and expenditure info and make an offer based on what you can afford."You've been reading SOS when it's just your clock reading 5:05 "0 -

If it doesn't then there is nothing to be repaid, if it does then they want you to repay it. The amount they are proposing is a starting point as specified in the regulations. They don't know whether this is unaffordable unless you tell them it is and come to an arrangement that is affordable.
But, first of all determine an overpayment exists, hence the advice about a SAR.0 -

I'm not sure what other advice you would like. You're out of time to dispute any overpayment now anyway.
