Overpayment

Hi, 

I recently received a letter asking for payment of an overpayment from 2012. At the time this happened I disputed the overpayment with HMRC with correspondence back and forth. Then I heard nothing from the last letter I sent them. Around a month ago I received a letter asking for repayment. Surely after this long with no correspondence they can’t expect it back? Also I can’t remember what the dispute was and after all this time I don’t have any original papers. Has anyone else been through this in this kind of time frame?

    Your post is very common on MSE. HRMC can and do regularly go back to 2011/2012 for tax credit over payments. Legally there is no time limit for them. 

    You could try complaining to HMRC and your MP.
    The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.

    You can make a Subject Access Request (SAR) to HMRC and you will receive all the information they hold for you, including past awards etc. https://www.gov.uk/guidance/hmrc-subject-access-request

    Not sure whether complaining will help you here though.

  • As poppy says you can do a SAR, but that isn't going to help if the dispute was unsuccessful or didn't get resolved as you will be out of time to challenge it now. HMRC can go back that far to recover a debt.
