New TV - Damaged on arrival

    by “internal” I mean if has the appearance of being cracked with broken vertical lines on screen. But there is no evidence of a crack on the glass. Tv also turns itself off after 5 seconds.

    Presumably the retailer will note that it's broken (OP has told them) and won't automatically refund them.

    That's not such a good idea.

    Firstly any refund depends on the state of the returned item, and if the TV is damaged then any refund is unlikely.

    Did you immediately report the damage /fault to the tv supplier ?

    If you reported it to them sraight away you should not be having a problem with them.The tv can have suffered impact damage either before or after it was boxed,the box may not show damage.

    This happens a lot with couriers as they fall down in their vans and they don't care how they treat them.

    Did you pay with credit card?

    That's not such a good idea.

    That would depend upon whether the retailer provided the correct durable information regarding the right to cancel.

    Regarding the issue, the regs state goods do not conform unless established otherwise when raised within 6 months, as per below.

    As the trader has used an agent to undertake delivery of the goods to the consumer they aren't in a position to simply state the consumer caused the damage and end of discussion. They are entitled to inspect the goods and come to this conclusion, but they'd need something to show beyond the balance of probability that the consumer damaged the goods rather than it being the consumers responsibility to show the goods were damaged before they came in to possession of them.

    (14)For the purposes of subsections (3)(b) and (c) and (4), goods which do not conform to the contract at any time within the period of six months beginning with the day on which the goods were delivered to the consumer must be taken not to have conformed to it on that day.

    (15)Subsection (14) does not apply if—

    (a)it is established that the goods did conform to the contract on that day, or
