No road tax and insurance

I bought a used car online a couple of days ago. When I collected it I was told the garage owner who wasn’t there had sent off the V5 and I would get it soon. I checked with the garage owner later and he said the person he bought the car from didn’t actually  have the V5 so he sent off a V62 form to transfer ownership to me. The DVLA site says they take 4-6 weeks to arrive.

I can’t tax my car without the V5.

My question is if I drive the car without road tax is my insurance valid?

    (1) I've never seen a car insurance policy that made taxing your car a condition of cover, and 
    (2) Even if yours did, your insurer would still only be able to refuse to pay a claim if your breach of the terms contributed to the claim - in other words they would have to show that the accident would not have happened had your car been taxed. It is difficult to imagine an accident that could have been prevented by taxing your car.

    So yes, it's still valid.

    OTOH you could still get a substantial fine (but no points) if you drive an untaxed car.

    Can you post back when ANPR pings a stop for no VED & what the police say about driving a car with no tax...

    They can impound it. Especially given you know it is & can't be taxed yet. Given that it might take 4 to 6 weeks to be able to release it with proof of being taxed. That is going to be one hell of a release fee....

    Terms will be in your insurance policy with regards your responsibilities. 
    Edit. If it is illegal to be on the road with no tax, then struggling to see how the insurance will be valid/honoured in a bump.

    It's also illegal to drive at 35mph in a built up area, to accelerate rather than brake when the light ahead turns amber, and to pull out of a junction without looking properly. Would you be surprised to learn that your insurance will be valid/honoured if you have a bump while doing one if those things?

    And unlike not paying your VED all those things actually have the potential to be the cause of an accident. 
  • Have you checked if its showing as taxed or not?  VED might not have been cancelled.

    Be careful - insurers often ask if you're the registered keeper.  If they do, you need to answer honestly.

    The dealer really should not have sold it until the V5 came through.

    Thank you to everyone for taking the time to post replies.

    I’ll phone DVLA tomorrow to ask if there is anything they can do. From looking around online however it seems it’s impossible to tax it without the V5.

    I’ve checked online and the tax expired on 1 October. I don’t have a driveway so I have no off-road place to park. Aside from the insurance issues, I don’t know what my chances are of leaving it parked on the road and not getting fined/clamped if it does end up taking a few weeks for the V5. Argh what a mess!

    Erm, whatever. OK, call up your insurance and check with them, shouldn't be an issue then. I know they can play silly games with small changes that also don't cause accidents.

    My concern would be someone un taxed causing an accident and the insurance saying nah, not happening. Don't really care if the untaxed driver ends up in court over it.
