Need advice

So today I Bought hotwheels unleashed (Disc) from game today wanted series x version but the lady behind the till gave me Xbox one/Series X version & when I questioned her, she said I can upgrade via console to X/S version and that only version they had in stock will check when I get home as don’t think you can upgrade version I got according to Microsoft 

what are my rights as I wanted series X version have opened case to check inside & says Xbox one on disc will put disc in to check if I can upgrade. 

Advice needed can I get refund if game lied to me

Being given wrong information doesn't mean you are being lied to, it could be a genuine mistake and somethingthe person genuinely believes.  As you haven't even tried to update it yet you are crying before you are hurt. 

Why do so many people automatically think they are being lied to as the default position?

You're probably better not trying it and just returning it unopened under their return policy.

OP says they’ve already opened it to check it,

There is no "upgrade" option.  The disc you got is both the One and SeriesX/S version.

There is no Series X version.  There is an Xbox version.

I suspect the graphics will vary based on the machine it is used in.

Regardless, you've opened it now and bought in person so you're going to have to show it doesn't do what you were told it will.

On the Microsoft store there is a series X/S version and on game website there is series X version is which I wanted so gonna take back for refund

Update went to game as i had opened the case they wouldn't give me refund due to i could of used the code inside the box and couldn't do a straight swap as had non in stock but did suggest I pay £15 extra for challenge accepted edition Series x version comes with all dlc etc so was happy to pay that
