Hi,
I'm on a contract for £57 per month for virgin media TV and broadband, they've been charging us £32 for some time.
Are virgin media legally allowed to request the remainder of the £57 or are they liable due to them collecting the amount via a direct debit?
Thanks

Yes they can ask for it. Keep it on one side (maybe in an interest gathering account) until when (or if) Virgin notice.

ThanksIf you had been paying them £90 a month and only just realised, would you expect a refund or for VM to say tough luck? That's the whole point of a contract.1 -

All I'm going to say is:You know you're paying £32 when you should be paying £57, even more so if all the documentation you received from Virgin says you should be being charged £57. Its your decision on whether you want to tell them about this. It may be a Virgin equivalent of "bank error in your favour" but:It may well be they never notice. But there is the so-called "six year rule" for this sort of thing, so you're basically hoping they don't notice until the year 2027. Which is a bit of a stretch to be honest, and you'll forget all about it at the end of this contract and post here in 2024 "virgin claim I owe them £450"Your "get out of jail" card for a future "they claim I owe £450" post will be your attempts to let them know of the issue. So if you keep telling them and they do nothing about it every time, you'll have the high ground with "I told you seven times, but you kept charging me £32 when it should have been £57" when the request comes. But if you do nothing, then you'll have nothing to fall back on.As above, if the deal was for £32 and they kept charging you £57, you'd be all over them like a rash to get it sorted.0
