Britannia Parking PCN

Hey - hope everyone's doing okay!

After managing to get by 2 and a bit years (I think!) without a PCN, finally, the day has come.

Got an ANPR PCN NTK a couple of days ago. I know, 99% of PCNs are covered in the sticky post(s) however, I have a quick question.

Details are not in my favour, app failure but without any records of me even trying.

The car park itself doesn't exist anymore. It's been scheduled for demolition because of the sheer state of it. It's a wonder the ANPR cameras are even on (Definitely haven't been on in the past, as I've been told. Must've turned them on to grab a bit of coin before knocking it down.)

I have no signage evidence as I didn't really remember to be vigilant about it. They were a state, the whole car park was looked ready to collapse. (Dex Multistory, Newcastle.)
I'd go grab evidence ASAP, but of course, it's closed permanently pending demo. What should I do in this case really, do I have a leg to stand on?

So far still at NTK Stage, and could appeal, I believe Britannia actually hold PCNs and keep the '14 days bribe grace' open after the appeal has come back?

On a side note, to understand something - PCNs by letter should include a larger 'grace' than 14 days, right? Or at least larger than windscreen pcns, according to BPA?

    The BPA CoP allows 28 days to appeal or pay , nothing to do with grace periods , Brit would then have 35 days to decide to cancel or issue a Popla code

    Did Britannia comply with POFA ? Yes or no ?

    They often use one company for the contractual obligations on the signage , compared to the NTK company

    The postal NTK will tell you if they complied with POFA or not , nothing to do with signage

    Sorry, figured you were on about confirming the reference between the company used on signage vs NTK, didn't read my PCN fully. 

    They've quoted Paragraph 9 of POFA, and stated that the signage states that the site is private land operated by Britannia Parking. This is the same as at the bottom, confirming Britannia Parking is a trading name of Britannia Parking Group Limited

    My apologies. 

    They've got POFA wording, however, I believe they fail in 9(2)(e) - Have only presumed in the driver, and not advised that they don't know the driver's details
    and 9(2)(b) - have not informed me that the parking charges have not been paid in full;

    In regards to everything else, they comply with POFA S4 P9.

    You should ask Britannia to prove that the app was working that day because you contend that it turns out it clearly wasn't.

    Hey! Street view is either Sept 2020 that doesn't the inside signs, and the outside sign is covered by a van.
    There's 2018 that shows the outside one in good nick, showing big writing of "Camera Controlled Pay on Arrival" but only inside sign visible is unreadable.

    Should I ask that via a appeal?
    My personal belief is that the car park has been removed from the list on Paybyphone early and that's caused issues.

    Why not get a load of photos now showing no signage, and put them to proof there was any?

    Are you saying you are still in appeal time and in those few days the signs came down?   Get dated photos (embed the date and time from the metadata into each photo) and use that as your evidence WITHOUT saying you know what it looked like the other week.
