    I'd just wait and see, who cares whether Elms or Excel themselves are handling it, going forward.

    So, since my last post...

    1. Rejected the Excel offer and offered £15.00 which they rejected
    2. Got hearing date in the new year which will be remote
    3. Received Excel's WS and bundle
    4. Got another (higher) settlement offer from Excel which I'll reject again
    5. New offer says they'll try and claim another £220 for local solicitor costs if I don't settle - feels like scaremongering to me!
    Some key points I noted in their WS and bundle.
    1. They include a statement of authority on Excel letterhead which has been completed by a company who claim to be the landowners but, I believe they are only management agents. A land registry search for the land in question states it is owned by a pension trust. The letter says a contract exists between the company (who I believe are managers) and Excel and is dated 2019 to 2024.
    2. They have included in their bundle a copy of my without prejudice offer to them - I'm fairly sure this shouldn't be included but, should I do anything about this or will the court simply discount it as evidence?
    I also notice that in the last month or so, all the meters and signs in the car park have been covered with bin bags... Have to wonder if someone has noticed something is not in place that should be!

  • Sorry, should have said I have until Jan so have started drafting it but not yet sent.
  • Would just like to say a big thank you for the help I’ve received on here.

    Had the hearing recently and the judge dismissed the case! He was clearly disappointed they’d brought it to court even though they had been paid and I’d appealed explaining my mistake.

    He didn’t even look at my evidence as my defence and the claimants evidence was enough for him to make his mind up.

    Have you got stats to make you say that?  Our stats are 99% wins in court since 2016.

    Makes no odds if they win some battles.  The parking rules war has been won by the consumer side/motoring groups and MPs, do you agree?
