Day 2 test didn't arrive and refund denied

Has anyone successfully received a refund for a failed day 2 Covid test delivery. I ordered weeks before travel and it's now day five after I returned. Assured Screening claim that once they issue a locator number there are no circumstances in which they give a refund. Surely this is against the law. I notice on the Competition and markets authority website that they have written to all test providers about there onerous terms and conditions that are too one sided to be legal. Assured Screening have again refused to refund so my only alternative is the small claims court.

  • NHS Test & Trace say that you  can make a complaint about a test provider to them  so that it will help them to improve the service. Link is here :

    Around 50 providers have been taken off the list for failing to meet the Government standards.

    Not if the T&C's make it clear that they can't guarantee service, which their T&C's almost certainly did.

    The government has indicated that such terms are unfair.

    In any case, if you just do the chargeback there is a good chance they won't challenge it. Their ability to organise is clearly limited.

    The Government can indicate whatever they want.  Until they put their money where their mouth is and test this in court I'll give it much thought as I do their other opinions.  That being none.

    They also indicated that not giving people refunds for cancelled holidays was unfair.  Didn't have the whats-it's to test that opinion out in court either.
