How to get off mortgage with ex

I have been split up with my ex for almost 15 years. I am still stuck on the mortgage. My ex is still living I the house and since leaving he has paid everything which was the agreement when I left. And I always said I don’t want anything from the house. Just my name off to be able to move on. I have since married and have a family but unable to buy a house with my partner due to still being on the mortgage with my ex. My ex has refused to sell over the years, Can I force the sale? There was a secured loan on the property which is being paid off. My ex has said a number of time that he will remortgage when he can. But due to the secured loan he can’t… 15 years down the line is too much!

You can force the sale but it will cost you.
Given that you still own 50% of the house, tell him you’re going to force the sale for 50% of the equity unless he buys you out or sells the property.

I’ve tried saying that in the past and he tells me I can’t and he won’t move. Do you know how much it would cost. And what about the secured loan. That’s not paid off yet.0

I think after 15years you should now want more than you name. If he had done what an ex should do you would have bought a house by now and it would have gone up in value including the enjoyment of owning your own home. You saying you want only your name off was long ago when you thought he will do as he says. Now seek legal advice and ask for half hopefully some will cover the legal costs and some can go towards your own house seeing that he has underestimated you. Would your ex agree to a Transfer of Equity? That is, he stays on the mortgage and the title and your name comes off both mortgage and title. You say you don't want anything from the house, so if the secured loan is being paid off, surely your ex could re-mortgage in his own name, particularly if there is no payment of any equity to you?0

Seek legal advice. A letter from a solicitor may trigger a response. Going to court will be expensive. Though intransigence would see your ex liable for your costs. That has been talked about In the past but I was lead to believe that that couldn’t happen because of the secured loan oh and the fact it was in negative equity ( this was about 4-5 years ago). Things may have changed now because of the the house market has gone. I feel like I have been fobbed off and it now gone on too long.0

You were advised that you could force the sale back in 2014. Why have you let things continue you to fester for another 6 years?
