Can we complete with outstanding enquiries?

Our sellers solicitor is being really slow getting back to my solicitor on outstanding enquires (related to search results). Would it be possible to complete without the replies if we took out indemnity insurance?

Solicitors don't provide the answers. The vendors or a third party do. What are the outstanding enquiries? Will an indemnity policy suffice to protect the mortgage lenders interests?0

If you require a mortgage your lender may not be happy until enquiries have been answered.

Generally no, but as above it depends on what the enquiries actually are. A lost FENSA certificate is no big deal, but HS2 running alongside the property in the next few years mostly certainly is.0

1) if you are getting a mortgage, the lender may not allow this. They'll be guided by their legal adviser (your solicitor!)2) have you reviewed the outstanding enquiries? Are you happy to buy without knowing the answers?3) indemnity insurance may or may not protect you - depends what the enquiries are.0

My vendor was taking ages to respond to enquiries, mainly producing evidence about boiler servicing and FENSA certificates. The windows were installed in 2007 so I wasn’t bothered about the certificate for them.It was costing me £250 a week for cattery fees, furniture storage and temporary accommodation so I decided it would be cheaper to go ahead without these. However as others have pointed out, I didn’t have a mortgagee to satisfy. I did have to confirm to my solicitor that I was happy to go ahead without these, against their advice.Life is mainly froth and bubble: two things stand like stone. Kindness in another’s trouble, courage in your own.0

Thanks for all your responses. We do require a mortgage and the enquiries relate to an unadopted road. Sounds like I’ll just have to be patient!0
